TEXTORITY REFUND AND CANCELLATION POLICY

Last Updated: September 30, 2026

This Refund and Cancellation Policy applies to refund, cancellation, reversal, and related transaction-remedy functionality made available through textority.com, text.me, text.to, lets.talk, the Textority web platform, and related online services operated by Textority Inc.

1. PURPOSE AND SCOPE

1.1 What this Policy governs. This Policy governs refund and cancellation treatment for paid Creator Offerings and Textority paid plans, including refund requests, cancellation requests, full and partial refunds, non-delivery, material misdescription, unauthorized or duplicate charges, Creator unavailability, scheduled services, Digital Content, recurring Creator Offerings, refund method, refund timing, and the interaction between refunds, Creator Balances, and Payment Disputes.

1.2 Who this Policy applies to. This Policy applies to Users who purchase paid Creator Offerings or Textority paid plans, Creators whose Creator Offerings are subject to refund or cancellation activity, authorized Creator Team Members acting within assigned permissions, and guardians or other payers where the Terms of Service permit a purchase connected to a Teen User.

1.3 What this Policy does not comprehensively govern. Detailed payment authorization and transaction accounting are governed by the Payment Terms. Detailed Creator payout mechanics are governed by the Creator Payout Terms. Detailed automatic-renewal mechanics are governed by the Subscription and Auto-Renewal Terms. Detailed chargeback and Payment Dispute procedures are governed by the Chargeback and Payment Dispute Policy. Detailed Digital Content delivery and access rules are governed by the Digital Content Delivery and Access Policy.

1.4 Transaction-specific treatment. The party that is legally or contractually responsible for issuing, funding, facilitating, administering, or recording a Refund may vary by transaction structure, Payment Provider configuration, Transaction Terms, and applicable law. This Policy does not designate Textority as merchant of record or contracting seller for every Creator Offering transaction.

1.5 No advice. This Policy describes contractual refund and cancellation rules. It is not legal, tax, accounting, banking, or financial advice.

2. RELATIONSHIP TO OTHER TEXTORITY TERMS

2.1 Additional Terms. This Policy is Additional Terms under the Textority Terms of Service (the “Terms of Service”). The Terms of Service continue to apply.

2.2 Creator Terms and Payment Terms. The Creator Terms govern Creator-specific responsibilities. The Payment Terms govern payment authorization, transaction structure, payment methods, fees, taxes, balances, refunds, reversals, Payment Disputes, and related payment mechanics.

2.3 Creator Payout Terms. The Creator Payout Terms govern how a Refund, reversal, Payment Dispute, negative balance, Reserve, Hold, or other adjustment may affect a Creator Balance or Payout.

2.4 Transaction Terms and Creator Policies. Transaction Terms and properly incorporated Creator Policies govern transaction-specific refund, cancellation, rescheduling, delivery, access, and service terms to the extent they do not conflict with higher-priority Textority terms or mandatory law.

2.5 Mandatory law. Nothing in this Policy overrides, limits, or waives a non-waivable right or remedy available under applicable law.

2.6 Order of precedence. The order of precedence stated in the Terms of Service applies.

3. PARTIES, ROLES, AND APPLICATION

3.1 Textority. Textority Inc. operates the Services and may provide, administer, facilitate, route, support, or record refund and cancellation functionality where the applicable transaction structure permits or requires it.

3.2 Creator. A Creator supplies, performs, delivers, and supports its Creator Offering and is responsible for the accuracy of the offering description, material delivery or performance commitments, Creator Policies, and other Creator obligations stated in the Terms of Service and Creator Terms.

3.3 Transaction-specific seller and payment roles. The applicable checkout, Transaction Terms, order confirmation, receipt, Payment Provider configuration, and law determine who is the contracting seller, merchant of record, payment recipient, or other legally relevant participant for a paid Creator Offering.

3.4 Creator Team Members. A Creator Team Member may handle refund or cancellation activity only within assigned permissions. Assigned access does not by itself make the team member the Creator, seller, payment recipient, payout recipient, or person financially responsible for the Creator’s refund obligations.

3.5 Entity accounts. Where a buyer or Creator is an entity, the entity is the contracting party unless the applicable Transaction Terms state otherwise. An authorized representative does not become personally responsible for the entity’s commercial obligations solely because the representative acts for the entity.

3.6 Guardians and Teen Users. Refunds and cancellations relating to a purchase connected to a Teen User are handled consistently with the guardian and payer framework in the Terms of Service and applicable Transaction Terms. A Teen User does not become the financially responsible purchaser merely by accessing a purchased Creator Offering.

4. ACCEPTANCE AND EXERCISING RIGHTS

4.1 Acceptance. This Policy applies where it is made available and identified as applicable to the relevant account, purchase, enrollment, or transaction in accordance with the Terms of Service.

4.2 Exercising a right is not new acceptance. Requesting a Refund, requesting a Cancellation, contacting support, reporting fraud or an unauthorized charge, submitting a Payment Dispute, initiating a chargeback, making a consumer complaint, or exercising a statutory or contractual right does not by itself constitute new acceptance of this Policy and does not waive any right.

4.3 Existing terms remain applicable. Terms properly accepted for the relevant account, purchase, or enrollment continue to apply according to their terms, subject to mandatory law.

5. DEFINITIONS

Capitalized terms not defined here have the meanings given in the Terms of Service, Creator Terms, Payment Terms, and Creator Payout Terms.

“Cancellation” means stopping a future charge, renewal, access period, or scheduled performance according to the applicable terms. Cancellation is not automatically a Refund.

“Creator Refund and Cancellation Terms” means the refund, cancellation, rescheduling, no-show, and related terms included in applicable Creator Policies and presented for a Creator Offering.

“Full Refund” means a Refund of the entire amount properly refundable for the applicable transaction.

“Material Misdescription” means a difference between what was materially represented before purchase and what was actually supplied or performed that would reasonably matter to the purchasing decision.

“Non-Delivery” means that a promised Creator Offering, or a material component of it, was not delivered, made accessible, or performed as required by the applicable Transaction Terms.

“Partial Refund” means a Refund of less than the entire amount charged for a transaction.

“Pro-Rata Refund” means a Partial Refund calculated by reference to an undelivered, unused, unperformed, or unexpired portion where the applicable terms or law establish that method.

“Refund” means a return of all or part of an amount charged for a transaction through the applicable payment flow.

“Refund Destination” means the Payment Method, financial account, or other legally and operationally permitted destination to which a Refund is sent.

“Refund Method” means the payment or provider mechanism used to process a Refund.

“Scheduled Creator Service” means a Creator Service intended to be performed at a scheduled date or time, including a consultation, session, class, workshop, or booking.

6. REFUND AND CANCELLATION ARCHITECTURE

6.1 No universal refund administrator. Depending on the actual transaction structure, a Refund may be issued, initiated, funded, facilitated, administered, or recorded by Textority, a Creator, a Payment Provider, another transaction participant, or a combination of them.

6.2 Textority-controlled processes. Where Textority controls or is authorized to direct the relevant refund or cancellation process, Textority may take the action required or permitted by this Policy, the Transaction Terms, Creator Policies, Payment Terms, provider or network rules, or applicable law.

6.3 Other responsible parties. Where another transaction participant is responsible for issuing or processing a Refund, Textority may route the request, provide relevant records, enforce applicable platform obligations, or otherwise assist within the scope Textority controls.

6.4 No second transaction. A Refund or Cancellation does not by itself create a new purchase transaction or change the commercial roles applicable to the original transaction.

6.5 Mandatory responsibilities remain with the responsible party. A contractual allocation does not transfer an obligation that applicable law independently places on Textority or another transaction participant.

7. CREATOR POLICIES, PLATFORM RULES, AND MANDATORY LAW

7.1 Creator Policies. A Creator may establish lawful Creator Refund and Cancellation Terms for a Creator Offering where those terms are properly presented before purchase or enrollment.

7.2 More generous terms. A Creator may offer terms more generous than Textority’s baseline rules. Where those more generous terms are properly incorporated into the transaction, they apply according to their terms.

7.3 Limits on Creator Policies. A Creator Policy may not waive a mandatory consumer right, contradict a higher-priority Textority term, retroactively reduce a buyer’s rights, or create a refund or cancellation restriction that applicable law prohibits.

7.4 No categorical finality against mandatory rights. A statement such as “all sales are final” or “non-refundable” may apply only to the extent lawful and properly disclosed. It does not eliminate a right arising from mandatory law, a higher-priority Textority term, a valid provider or network rule, Non-Delivery, or another binding remedy.

7.5 No universal change-of-mind guarantee. Except where applicable law, Transaction Terms, Creator Policies, or Textority expressly provide otherwise, this Policy does not create a universal satisfaction guarantee or change-of-mind Refund right.

7.6 No retroactive reduction. Refund, cancellation, rescheduling, delivery, access, and service terms applicable to a completed purchase may not be retroactively reduced where the governing terms or law prohibit that change.

8. PRE-PURCHASE DISCLOSURE AND VERSION LOCKING

8.1 Material terms. Before a purchase or recurring enrollment is completed, the applicable flow should present or make reasonably available the material refund and cancellation terms relevant to that transaction, together with the other material Transaction Terms.

8.2 Creator Offering information. Where applicable, material information includes the Creator identity, offering description, price, currency, recurring terms, delivery or performance method, access duration, cancellation or rescheduling rules, refund terms, and material limitations.

8.3 Version presented. Subject to higher-priority terms and mandatory law, the material refund and cancellation terms presented for the transaction govern that transaction.

8.4 Records. Textority may retain transaction records, version identifiers, timestamps, acceptance records, and other evidence reasonably necessary to document what was presented or accepted, subject to applicable privacy and retention requirements.

8.5 No unsupported capability. This Policy does not represent that a particular checkout, refund, cancellation, or account feature exists unless Textority actually makes it available.

9. HOW TO REQUEST A REFUND OR CANCELLATION

9.1 Available routes. A User may submit a Refund or Cancellation request through the account, transaction history, receipt, support route, Creator support route, Payment Provider process, or other method made available for the applicable transaction.

9.2 Information that may be requested. A request may require reasonable information such as the transaction identifier, purchase date, offering or plan, amount, reason for the request, relevant communications, and evidence of Non-Delivery, Material Misdescription, duplicate billing, cancellation, or another claimed basis.

9.3 No unnecessary information. Textority will not require information that is unrelated or disproportionate to evaluating the request or complying with law, provider rules, fraud prevention, or recordkeeping obligations.

9.4 Prompt reporting encouraged. Users should report payment and delivery problems promptly because provider, network, Creator Policy, and statutory periods may apply. Prompt reporting does not shorten a longer non-waivable period provided by law.

10. CONTACTING THE CREATOR FIRST

10.1 Not a universal precondition. A User is not required to contact the Creator first before using a Textority support route, exercising an External Payment Right, or invoking a statutory right unless the applicable legal process itself requires notice to the provider or another party.

10.2 Creator contact may help. For delivery, performance, rescheduling, or product-specific questions, contacting the Creator may permit faster resolution where the Creator is the party able to cure the issue.

10.3 No interference with legal rights. Textority and Creators may not require an informal support process to be completed first where doing so would unlawfully delay, burden, or waive a mandatory consumer, payment, or statutory remedy.

11. REVIEW, ESCALATION, AND AUTHORITY

11.1 Review. A Refund request may be reviewed against the applicable Transaction Terms, Creator Policies, payment records, delivery or access evidence, performance records, communications, provider rules, and applicable law.

11.2 Textority action where authorized. Where Textority controls or is authorized to direct the relevant process, Textority may approve, deny, partially approve, facilitate, require, or escalate a Refund or Cancellation consistent with the governing terms and law.

11.3 Mandatory outcomes. Where applicable law, binding Transaction Terms, a properly incorporated Creator Policy, or a controlling provider or network rule requires a Refund or Cancellation, the responsible party must comply with that requirement.

11.4 Discretionary outcomes. Where no source creates a mandatory entitlement, Textority may exercise reasonable discretion within the scope Textority controls to address fraud, platform integrity, Non-Delivery, Material Misdescription, Creator unavailability, prohibited activity, safety risk, or comparable circumstances. Exercising discretion in one case does not create an entitlement in another.

11.5 No guaranteed result where third parties control. Textority cannot guarantee that a bank, issuer, Payment Provider, Creator, payment network, or other independent party will approve, process, or complete a Refund where that decision is controlled by the third party.

12. INFORMATION, EVIDENCE, AND COOPERATION

12.1 Buyer information. A buyer may be required to provide truthful information reasonably necessary to evaluate a request.

12.2 Creator cooperation. A Creator must cooperate reasonably with refund, cancellation, delivery, performance, fraud, and Payment Dispute inquiries and must provide accurate evidence reasonably requested under the Creator Terms.

12.3 Relevant evidence. Evidence may include transaction records, Creator Policies, delivery logs, access records, booking records, communications, service records, cancellation confirmations, refund records, provider records, and other information relevant to the request.

12.4 No fabricated evidence. No User may fabricate, alter, conceal, or knowingly misrepresent material evidence in connection with a Refund, Cancellation, Payment Dispute, complaint, or investigation.

13. GENERAL REFUND AND CANCELLATION GROUNDS

13.1 Sources of entitlement. A Refund or Cancellation may be required by applicable law, Transaction Terms, Creator Policies, Textority terms, provider or network rules, or another binding source applicable to the transaction.

13.2 Common grounds. Depending on the governing terms and facts, grounds that may require or support relief include Non-Delivery, Material Misdescription, duplicate billing, unauthorized charges, Creator cancellation, Creator inability to perform, unlawful or prohibited activity, an applicable statutory withdrawal right, or another material failure to provide what was promised.

13.3 Dissatisfaction alone. Dissatisfaction, a change in preference, or non-use does not automatically create a Refund unless a governing term or law provides that right.

13.4 Product-specific analysis. The appropriate outcome may differ for Digital Content, a Scheduled Creator Service, a membership, a subscription, a course, a booking, or another Creator Offering.

14. NON-DELIVERY

14.1 Reporting. A buyer may report that a Creator Offering or a material component was not delivered, made accessible, or performed as required by the applicable Transaction Terms.

14.2 Evidence. Review may consider delivery records, access records, service records, Creator communications, technical incidents, and whether an alternative lawful delivery method was offered and accepted.

14.3 Cure. Where lawful and reasonable, a prompt cure, restoration of access, replacement delivery, rescheduling, or completion may resolve the issue without a Refund if the buyer’s governing rights are preserved.

14.4 Refund where required. If Non-Delivery creates a Refund right under applicable law or binding terms, the responsible party must provide the required remedy.

15. MATERIAL MISDESCRIPTION OR MATERIAL DIFFERENCE

15.1 Material comparison. A Refund request based on Material Misdescription is evaluated by comparing the material pre-purchase representation with the offering actually supplied or performed.

15.2 Minor differences. A minor stylistic difference, subjective dissatisfaction, or immaterial variation does not by itself constitute Material Misdescription.

15.3 Material omissions. A material omission can support a claim where applicable law or the governing terms treat the omission as misleading or as a failure to provide what was promised.

15.4 Creator responsibility. A Creator is responsible for accurate and non-misleading offering descriptions under the Creator Terms.

16. UNAUTHORIZED, FRAUDULENT, DUPLICATE, OR ERRONEOUS CHARGES

16.1 Reporting. A User may report an unauthorized, fraudulent, duplicate, or incorrect charge through the routes made available by Textority or the applicable Payment Provider and may also use any External Payment Right available through the User’s financial institution.

16.2 Internal review does not replace external rights. A Textority review does not replace a statutory or contractual unauthorized-transaction or billing-error process administered by a card issuer, bank, wallet provider, or other financial institution.

16.3 Duplicate or incorrect Textority-controlled charges. Where Textority confirms a duplicate or incorrect charge within the scope Textority controls, Textority may correct the error through an appropriate Refund, reversal, credit, or other lawful adjustment.

16.4 Fraud controls. Textority may request verification or supporting information reasonably necessary to distinguish a genuine unauthorized transaction from account misuse, friendly fraud, or another abusive claim.

17. CREATOR UNAVAILABILITY, BREACH, PROHIBITED ACTIVITY, AND SAFETY REMOVAL

17.1 Creator unavailable or unresponsive. A Creator’s material unavailability or failure to respond may support further review where it prevents delivery, performance, support, or a legally required remedy.

17.2 Creator breach. A Creator’s violation of the Terms of Service, Creator Terms, Transaction Terms, or Creator Policies may support a Refund, Cancellation, restriction, or other remedy where the breach materially affects the buyer’s transaction or where applicable law requires relief.

17.3 Prohibited activity. If a Creator Offering violates the Prohibited Products and Services Policy or applicable law, Textority may restrict or remove the offering and may take refund or transaction action within the scope Textority controls where authorized or required.

17.4 Removal does not create a universal refund rule. Removal, suspension, or termination does not automatically require the same Refund outcome in every case. Mandatory law and existing buyer rights remain controlling.

18. DIGITAL CONTENT AND ACCESS

18.1 Digital Content is not automatically final sale. This Policy does not impose a universal rule that Digital Content becomes non-refundable merely because it was delivered, opened, downloaded, streamed, viewed, or accessed.

18.2 Use may be relevant. Access, download, streaming, consumption, completion, and access duration may be relevant to a Creator Policy, a fraud review, calculation of a Partial Refund, or a statutory exception where applicable law makes those facts relevant.

18.3 Delivery problems. Inaccessible, corrupt, materially incomplete, or otherwise unusable Digital Content may be evaluated under the Digital Content Delivery and Access Policy and the applicable Transaction Terms.

18.4 Immediate performance or access. Where a legal right of withdrawal can be limited or excluded because performance began or access was provided with the consumer’s agreement, that limitation applies only if the requirements of the applicable law are actually satisfied.

18.5 Purchased access. A Refund may result in termination of the refunded access or license to the extent permitted by applicable law and the applicable Transaction Terms.

19. SCHEDULED CREATOR SERVICES AND BOOKINGS

19.1 Creator cancellation. If a Creator cancels or cannot perform a Scheduled Creator Service, the Creator should offer the remedy required by applicable law and the governing terms, which may include rescheduling, substitute performance where appropriate, or a Refund of the unperformed portion.

19.2 Buyer cancellation. A buyer’s right to cancel or reschedule a Scheduled Creator Service depends on the applicable Creator Refund and Cancellation Terms, Transaction Terms, and mandatory law.

19.3 No universal cancellation window. This Policy does not establish a universal 24-hour, 48-hour, or other cancellation cutoff.

19.4 No-show rules. A no-show fee, forfeiture, or reduced Refund applies only if lawful, properly disclosed before purchase, and supported by the applicable transaction terms.

19.5 Partial performance. Where a Creator Service has been partly performed, the appropriate remedy may be a Partial Refund or another lawful remedy rather than a Full Refund, depending on the governing terms and law.

20. RESCHEDULING AND ALTERNATIVE PERFORMANCE

20.1 Rescheduling. A buyer and Creator may agree to reschedule a Creator Service where the Services support it and the agreement does not waive a mandatory right unlawfully.

20.2 Alternative performance. A materially equivalent alternative may be offered where appropriate, but the buyer is not required to accept a substitute when applicable law or binding terms instead entitle the buyer to a Refund or Cancellation.

20.3 Records. A rescheduling or substitute-performance agreement may be recorded to document the revised performance terms.

21. MEMBERSHIPS, SUBSCRIPTIONS, AND RECURRING CREATOR OFFERINGS

21.1 Cancellation stops future charges. Cancellation of an automatically renewing Creator Offering stops future recurring charges according to the applicable effective date. Cancellation is not automatically a Refund of an earlier authorized charge.

21.2 Access after cancellation. Unless applicable law, Transaction Terms, or Creator Policies provide otherwise, cancellation may permit access through the end of the already-paid period.

21.3 Unauthorized post-cancellation charges. A charge submitted after a Cancellation became effective may be reviewed as an incorrect or unauthorized charge and remains subject to applicable law and External Payment Rights.

21.4 Recurring terms. Detailed enrollment, renewal, trial conversion, reminder, price-change, reauthorization, and cancellation mechanics are governed by the Subscription and Auto-Renewal Terms and applicable Transaction Terms.

21.5 No cancellation obstacle. A Creator may not impose a cancellation obstacle that Textority itself could not lawfully impose for the applicable transaction.

22. TEXTORITY PAID PLANS AND TRIALS

22.1 Plan cancellation. A User may cancel a Textority paid plan through the cancellation method Textority makes available for that plan. Cancellation stops future renewal according to its effective date.

22.2 Prior plan charges. Cancellation does not automatically create a Refund for a prior authorized Textority plan charge.

22.3 Plan Refunds. A Textority plan charge is refundable where applicable law, the applicable enrollment terms, a binding Textority commitment, or Textority’s exercise of discretion provides a Refund. This Policy does not create a universal plan Refund window.

22.4 Trials. A free or discounted trial converts to a paid plan only where the conversion, timing, resulting charge, and cancellation method were disclosed and properly authorized before enrollment.

22.5 No fixed trial period stated. This Policy does not promise a fourteen-day trial or any other universal trial duration.

23. FULL, PARTIAL, AND PRO-RATA REFUNDS

23.1 Full Refund. A Full Refund may apply where the entire charge is required to be returned under applicable law or governing terms, or where the responsible party lawfully approves a Full Refund.

23.2 Partial Refund. A Partial Refund may apply where only part of the transaction is affected and a partial remedy is lawful and consistent with the governing terms.

23.3 Pro-Rata Refund. A Pro-Rata Refund applies only where the applicable law or terms establish a lawful proration method. This Policy does not create a universal proration formula.

23.4 No forced partial remedy. A Partial Refund or substitute remedy may not be used to reduce a Full Refund that applicable law or binding terms require.

24. REFUND AMOUNT, TAXES, DISCOUNTS, PROMOTIONS, AND CREDITS

24.1 Amount. The Refund amount is determined from the amount lawfully refundable for the transaction after considering the governing terms, mandatory law, prior Refunds, and other valid transaction adjustments.

24.2 Taxes. Transaction Taxes are refunded, adjusted, credited, reported, or retained according to applicable tax law and the actual transaction structure.

24.3 Discounts and promotions. A Refund is generally based on the amount actually paid for the refunded portion rather than an undiscounted reference price, unless applicable law requires otherwise.

24.4 Promotional credits. A promotional credit or non-cash benefit is handled according to the terms under which it was issued and applicable law. A mandatory monetary Refund may not be replaced with platform credit where the law requires money to be returned.

24.5 No double recovery. A User may not receive the same amount twice through a Refund, chargeback, reversal, credit, or other remedy.

25. TEXTORITY FEES, PAYMENT PROCESSING COSTS, AND THIRD-PARTY CHARGES

25.1 Textority Fees. Treatment of a Textority fee when a Refund occurs depends on the applicable fee terms, Transaction Terms, and law. This Policy does not create a universal promise that every Textority fee will be returned or retained.

25.2 Payment Processing Costs. A Payment Provider, bank, payment network, or other third party may retain or impose processing, refund, dispute, conversion, or other costs under its own rules. Those costs may be allocated according to the applicable payment terms.

25.3 Mandatory consumer amount controls. A fee rule or third-party cost may not reduce the amount that applicable consumer law requires to be returned to the buyer.

25.4 No undisclosed refund fee. Textority will not impose a refund-processing fee on a buyer unless the fee is lawful and was properly disclosed or otherwise permitted by the governing terms and law.

26. CREATOR FINANCIAL RESPONSIBILITY AND CREATOR BALANCES

26.1 Allocation. A Creator is financially responsible for a Refund, reversal, chargeback, dispute fee, or related transaction loss only to the extent the Payment Terms, Creator Terms, Creator Payout Terms, Transaction Terms, provider configuration, or law allocate that amount to the Creator.

26.2 Creator Balance adjustments. A properly allocated Refund may reduce a Creator Balance, Available Payout Amount, or future Creator Proceeds and may contribute to a negative balance as provided in the Payment Terms and Creator Payout Terms.

26.3 Refund after Payout. A Refund that becomes due after related Creator Proceeds have been paid out does not eliminate the underlying properly allocated obligation. Recovery may occur through a balance adjustment, offset, Reserve, Hold, provider debit, repayment request, or another method authorized by the applicable terms and law.

26.4 No double deduction. The same Refund or related adjustment may not be deducted twice for the same purpose.

26.5 Ordinary payment obligation. A properly allocated Refund, reversal, Payment Dispute, chargeback, or negative balance is a direct payment or accounting obligation under the applicable payment terms and is not converted into an indemnification claim merely because it affects the Creator.

27. REFUND METHOD, DESTINATION, AND TIMING

27.1 Original Payment Method. Where supported and legally appropriate, a Refund is ordinarily returned through the Payment Method or payment channel used for the original transaction.

27.2 Alternative destination. If the original Payment Method is unavailable, expired, closed, technically unable to receive the Refund, or otherwise unsuitable, an alternative destination may be used only where permitted by the applicable Payment Provider, Transaction Terms, fraud controls, and law.

27.3 Guardian purchases. A monetary Refund for a purchase connected to a Teen User is directed consistently with the payer and guardian structure rather than to the Teen User in a manner inconsistent with the original payment arrangement.

27.4 Initiation is not receipt. Refund approval and Refund initiation do not guarantee the date on which a bank, issuer, wallet, Payment Provider, or other financial institution will post the funds.

27.5 No universal processing period. Except where applicable law or binding terms require a specific period, this Policy does not promise same-day, next-day, or another universal Refund receipt time.

28. PENDING, FAILED, REJECTED, RETURNED, OR REVERSED REFUNDS

28.1 Provider processing. A Refund may remain pending, fail, be rejected, be returned, or require additional steps because of provider rules, closed or invalid accounts, unsupported payment methods, technical errors, compliance review, or other payment-system conditions.

28.2 Follow-up. Textority may request updated information or coordinate with the applicable Payment Provider where Textority controls or supports the relevant process.

28.3 No provider guarantee. Textority cannot guarantee that a third-party institution will successfully receive, trace, reissue, or post a Refund when that function is controlled by the third party.

28.4 Accounting corrections. An obvious erroneous or duplicate Refund may be corrected or recovered through a method authorized by the Payment Terms, provider rules, and applicable law.

29. PAYMENT DISPUTES AND CHARGEBACKS

29.1 Separate processes. A Refund and a Payment Dispute or chargeback are different processes. A Refund is a transaction remedy processed through the applicable refund flow; a Payment Dispute is handled under the rules of an issuer, bank, Payment Provider, payment network, or other Payment Method participant.

29.2 External rights preserved. Using a Textority Refund or support process does not waive an External Payment Right that cannot lawfully be waived.

29.3 No contact-first requirement. Textority may encourage a User to seek direct resolution before opening a chargeback, but doing so is not a condition to exercising a right available under applicable law, provider rules, network rules, or the User’s agreement with a financial institution.

29.4 Coordination. If a Refund and Payment Dispute concern the same amount, the parties may coordinate accounting and evidence to prevent double recovery.

29.5 Detailed procedures. Detailed Payment Dispute, representment, evidence, and chargeback procedures are governed by the Chargeback and Payment Dispute Policy when applicable.

30. COLOMBIA - RIGHT OF WITHDRAWAL (RETRACTO)

30.1 Applicability. Where Colombian consumer law applies to a distance or non-traditional sale and the statutory conditions for the right of withdrawal are satisfied, the consumer may exercise the statutory derecho de retracto notwithstanding a conflicting Creator Policy or other contractual term.

30.2 Five-business-day period. Under Article 47 of Colombia’s Consumer Statute, the maximum period to exercise the right of withdrawal is generally five (5) business days from delivery of a good or, for a service, from conclusion of the service contract, subject to the statutory conditions and exceptions.

30.3 Statutory exceptions. The right of withdrawal does not apply where a statutory exception applies. Those exceptions include, among others, a service whose performance has begun with the consumer’s agreement and the other exceptions established by Article 47 and applicable law.

30.4 Refund amount. Where the statutory right of withdrawal applies, the consumer is entitled to return of the sums required by Colombian law without contractual deductions or retentions that the statute prohibits.

30.5 Refund deadline. Where Article 47 applies, the required return of money may not exceed thirty (30) calendar days from the consumer’s exercise of the right, subject to the statute and any legally applicable rule that provides a shorter period for a particular case.

30.6 Digital Content and services. This Policy does not assume that all Digital Content or online services are automatically included in or excluded from the right of withdrawal. Applicability depends on the statutory characterization, whether performance has begun with the consumer’s agreement, and any other applicable exception.

31. COLOMBIA - PAYMENT REVERSAL AND E-COMMERCE REMEDIES

31.1 Statutory payment reversal. Where Article 51 of Colombia’s Consumer Statute and its implementing rules apply to an electronic-commerce transaction paid with an electronic payment instrument, a consumer may have a statutory payment-reversal right for circumstances including fraud, an unauthorized transaction, non-receipt, material nonconformity, or defect.

31.2 Statutory procedure. The Colombian payment-reversal process may require the consumer to present a complaint to the provider and notify the issuer of the payment instrument within five (5) business days of the event specified by law. The procedure, required information, participating entities, and exceptions are governed by Article 51, Decree 587 of 2016, and other applicable rules.

31.3 Processing period. Where the statutory reversal procedure applies and its requirements are satisfied, the participants in the payment process are subject to the processing period established by applicable law, including the fifteen (15) business-day period provided by Decree 587 of 2016 for making the reversal effective.

31.4 Periodic electronic payments. Colombian law may provide separate rights to revoke or reverse certain periodic electronic payments. Those rights apply independently of any narrower Creator Policy or Textority term.

31.5 E-commerce non-delivery or unavailability. Where Article 50 of Colombia’s Consumer Statute applies and a covered product or service is not delivered within the agreed period or the applicable statutory limit, or is unavailable, the consumer may have a statutory right to terminate and obtain return of sums paid within the period required by law.

31.6 Provider roles. Textority will perform a Colombian Refund, reversal, complaint, or payment function only to the extent Textority is legally responsible for that function or the applicable Transaction Terms and provider configuration assign that function to Textority.

32. UNITED STATES - RECURRING CHARGES AND REFUND RIGHTS

32.1 Recurring charges. For an online negative-option or automatically renewing transaction subject to the Restore Online Shoppers’ Confidence Act or other applicable U.S. law, material recurring terms must be disclosed as required by law, express informed consent must be obtained before charging where required, and a simple mechanism must be available to stop recurring charges.

32.2 Cancellation and prior charges. Stopping future recurring charges does not by itself require a Refund of a prior properly authorized charge unless applicable law, Transaction Terms, Creator Policies, or Textority terms provide otherwise.

32.3 State and local rights. State or local law may provide additional cancellation, renewal, refund, warranty, or consumer-protection rights. Those mandatory rights are preserved.

32.4 No universal U.S. cooling-off right created. This Policy does not create a universal U.S. change-of-mind or cooling-off Refund right for every Digital Content, subscription, or Creator Service purchase.

32.5 External payment rights. Rights available through a card issuer, bank, payment network, or other financial institution remain separate from Textority’s internal Refund and Cancellation process.

33. RECORDS AND AUDIT TRAIL

33.1 Records. Textority may maintain records relating to a Refund or Cancellation where Textority receives or administers those records, including the original transaction, Transaction Terms, Creator Policy version, request, evidence, decision, amount, provider status, cancellation effective date, balance effect, and communications.

33.2 Creator records. Creators must maintain records reasonably necessary to support their legal obligations and material transaction representations as required by the Creator Terms and applicable law.

33.3 Provider records. Payment Providers, issuers, banks, and networks may maintain separate records that control or supplement the transaction evidence within their systems.

33.4 Privacy and retention. Refund and Cancellation records are processed and retained subject to applicable privacy law, legal obligations, fraud prevention, dispute needs, and the applicable Textority privacy terms.

34. ABUSE, FRAUDULENT REQUESTS, AND GOOD-FAITH RIGHTS

34.1 Prohibited abuse. A User may not knowingly submit a false Refund request, fabricate Non-Delivery, manipulate evidence, seek double recovery, use a stolen Payment Method, or engage in systematic Refund or chargeback abuse.

34.2 Reasonable protective action. Textority may investigate suspected abuse and take action permitted by the Terms of Service, Payment Terms, provider rules, and applicable law.

34.3 Good-faith requests are protected. A good-faith Refund request, Cancellation, Payment Dispute, consumer complaint, report, or exercise of a statutory right does not by itself constitute abuse and is not grounds for retaliation.

34.4 No forfeiture of mandatory rights. A fraud-prevention or abuse rule may not be used to eliminate a non-waivable consumer or payment right.

35. CHANGES AND DISPUTE RESOLUTION

35.1 Changes. Textority may update this Policy prospectively in accordance with the Terms of Service.

35.2 Completed transactions. A later change does not retroactively reduce a Refund or Cancellation right that was binding for a completed transaction, subject to applicable law and higher-priority terms.

35.3 Legal or provider changes. Textority may update this Policy on a shorter timeline where reasonably necessary to comply with law, court order, regulator requirements, Payment Provider or network requirements, fraud prevention, security, or platform safety, subject to any mandatory notice requirement.

35.4 Dispute resolution. Section 29 of the Terms of Service governs legal disputes between a User and Textority, including the arbitration agreement, class action waiver, jury trial waiver, arbitration opt-out, governing law, and applicable exceptions.

35.5 External rights. Nothing in Section 35.4 eliminates a non-waivable statutory, regulatory, issuer, bank, payment-network, or Payment Provider process available to a User.
