TEXTORITY PRIVACY POLICY

Last Updated: September 30, 2026

This Privacy Policy explains how Textority Inc. (“Textority,” “we,” “us,” or “our”) collects, uses, discloses, retains, and otherwise processes personal information in connection with textority.com, text.me, text.to, lets.talk, the Textority web platform, and related online services that Textority makes available (collectively, the “Services”).

This Privacy Policy applies to visitors, Users, Creators, End Users, buyers, subscribers, guardians, Creator Team Members, and other individuals whose personal information Textority processes through the Services. It should be read together with the Textority Terms of Service and any privacy notice, consent, authorization, transaction notice, or other Additional Terms that apply to a particular feature, role, or jurisdiction.

1. SCOPE AND RELATIONSHIP TO OTHER TERMS

1.1 Scope. This Privacy Policy describes Textority’s general personal-information practices for the Services. A more specific privacy notice may supplement this Privacy Policy for a particular feature, transaction, category of information, or jurisdiction.

1.2 Terms of Service. The Terms of Service govern use of the Services. Capitalized terms not defined in this Privacy Policy have the meanings given in the Terms of Service or applicable Additional Terms.

1.3 Separate consent or authorization. Where applicable law requires consent, authorization, opt-in, or another affirmative privacy choice, acceptance of the Terms of Service or this Privacy Policy alone does not substitute for that separate action.

1.4 Third-party and Creator practices. This Privacy Policy does not govern the independent privacy practices of a Creator, Payment Provider, external website, external application, or other third party that determines its own purposes and means of processing. Those parties may have their own privacy notices and obligations.

1.5 Employee and applicant data. This Privacy Policy is not intended to be the primary notice for Textority employees, contractors, job applicants, or candidates acting solely in that capacity. Separate workforce or applicant notices may apply.

2. WHO TEXTORITY IS AND PRIVACY ROLES

2.1 Textority. Textority Inc. operates the Services and is responsible for personal information when Textority determines the purposes and means of processing for its own platform, account, support, safety, commerce, legal, analytics, and business operations.

2.2 Creator relationships. Creators operate Channels and may communicate with audiences, make Creator Offerings available, and receive information through the Services. A Creator may independently determine how to use personal information received through the Services and, when it does, is responsible for the privacy and data-protection obligations that apply to that use.

2.3 Activity-specific roles. Textority does not use this Privacy Policy to assign one controller, processor, Responsable del Tratamiento, Encargado del Tratamiento, or similar legal role to every data flow. The applicable role depends on the activity, the parties’ actual decisions and instructions, any separate agreement, and applicable law.

2.4 Creator Team Members. A Creator Team Member may access personal information only within permissions assigned by the Creator and the functionality Textority makes available. The Creator is responsible for provisioning and revoking team access as described in the Creator Terms.

3. WHAT “PERSONAL INFORMATION” MEANS

3.1 General. For this Privacy Policy, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an identified or identifiable individual, to the extent treated as personal data or personal information under applicable law.

3.2 Deidentified and aggregate information. Information that has been deidentified or aggregated so that it is not reasonably linked to an identifiable individual is not treated as personal information to the extent applicable law provides otherwise.

4. PERSONAL INFORMATION WE MAY COLLECT OR PROCESS

4.1 Account and identity information. Depending on how you use the Services, this may include your name, email address, mobile phone number, username or requested handle, account identifiers, login or authentication-related records, SMS verification requests and related delivery information, age or age-range information, guardian information where applicable, and other account or identity information you provide.

4.2 Profile, Channel, and public information. This may include display names, profile information, Channel information, Creator business or professional information, descriptions, links, Creator Content, Creator Offering information, and other information you choose to make available through public or audience-facing parts of the Services.

4.3 Communications and User Content. This may include messages, files, forms, prompts, instructions, configurations, support communications, feedback, Creator Content, and other User Content submitted, transmitted, generated, or made available through the Services.

4.4 Creator, business, verification, and eligibility information. For Creator, commerce, payout, professional, or higher-risk features, Textority or a service provider may process information reasonably required for identity, business, beneficial-owner, control-person, tax, payout, sanctions, professional-license, age, guardian, category, fraud, or other verification permitted by the governing terms and law.

4.5 Payment and transaction information. For purchases, subscriptions, refunds, disputes, payouts, and other commerce activity, we may process transaction amounts, currency, offering or plan information, payment status, order and transaction identifiers, refund and dispute information, payout information, tax-related information, and other records necessary to administer the transaction. Payment Providers may separately collect or tokenize Payment Methods and other payment credentials under their own terms and privacy notices.

4.6 Device, network, and usage information. The Services may process IP address, browser or device information, technical logs, security events, dates and times of access, feature interactions, website or Service interaction information, and similar technical information reasonably necessary to operate, secure, measure, and improve the Services.

4.7 Support, safety, moderation, and legal information. This may include support requests, reports, complaints, appeals, evidence, fraud indicators, account-security information, moderation records, transaction disputes, legal requests, preservation records, and information reasonably necessary to investigate or respond to safety, abuse, security, legal, or compliance matters.

4.8 Surveys and feedback. We may process survey responses, product feedback, research responses, and other information you voluntarily provide to help us understand or improve the Services.

4.9 AI and automation information. Where Textority AI or automation features are enabled, personal information may be included in prompts, instructions, knowledge sources, messages, inputs, outputs, configurations, feedback, usage records, or other context processed to provide the feature.

4.10 Sensitive information. Textority does not require every User to provide information classified as sensitive under privacy law. Depending on the feature, verification process, professional interaction, or User Content a person chooses to provide, the Services may process information that applicable law treats as sensitive. Where law requires separate consent or authorization for that processing, Textority will use the applicable consent or authorization process.

5. SOURCES OF PERSONAL INFORMATION

5.1 Information you provide. We receive information when you create or reserve an account or handle, complete a form or survey, operate a Channel, upload or send content, configure a feature, purchase or sell an offering, contact support, exercise a privacy right, or otherwise provide information through the Services.

5.2 Information generated through use. We may receive technical, usage, security, transaction, and interaction information generated when you access or use the Services.

5.3 Creators and other Users. A Creator, Creator Team Member, guardian, buyer, End User, or other User may provide information about another person when using the Services, for example through a conversation, transaction, team invitation, report, or support request. Users must have any authority or permission required by law to provide that information.

5.4 Service providers and transaction participants. We may receive information from Payment Providers, identity or business verification providers, fraud or security providers, communications or infrastructure providers, and other service providers or transaction participants where reasonably necessary for the Services and permitted by applicable law.

5.5 Connected or external services. If Textority enables an integration and you choose to connect or use it, we may receive information from the connected service according to the permissions, notices, and settings presented for that integration.

6. HOW WE USE PERSONAL INFORMATION

6.1 Provide and operate the Services. We use personal information to create and administer accounts, reserve or activate identifiers, authenticate Users, operate Channels, provide content and communications functionality, maintain Service features, and fulfill User requests.

6.2 Enable Creator and audience interactions. We use information to route communications, support Channel interactions, provide Creator-facing tools, deliver authorized content or access, and support relationships that Users choose to establish through the Services.

6.3 Support commerce. We use information to support checkout, subscriptions, transactions, Payment Provider integrations, refunds, disputes, balances, payouts, tax or verification workflows, transaction records, and related commerce functionality as described in the applicable Payment Terms and commerce policies.

6.4 Provide support. We use information to answer questions, troubleshoot issues, process requests, maintain transaction and account records, and communicate about the Services.

6.5 Protect Users and the Services. We use information to detect, investigate, prevent, and respond to suspected fraud, abuse, spam, unauthorized access, security incidents, prohibited activity, harmful conduct, policy violations, and other safety or integrity risks.

6.6 Analyze and improve the Services. We may use usage, interaction, feedback, technical, and transaction information to understand how the Services are used, diagnose problems, evaluate features, improve performance and usability, and develop or improve supported functionality. Analytics practices are subject to applicable law and the choices described in this Privacy Policy and applicable cookie or privacy notices.

6.7 Provide AI and automation features. Where enabled, we process information reasonably necessary to generate, route, evaluate, secure, or administer Textority AI and automation features as described in Section 9 and any applicable AI notice or Additional Terms.

6.8 Communicate with you. We use contact information to send account, service, security, transaction, support, legal, and other operational communications. We may also send marketing or promotional communications where permitted by law and subject to applicable consent and opt-out requirements.

6.9 Comply with law and enforce agreements. We use and preserve information where reasonably necessary to comply with law, respond to valid legal process, satisfy reporting or preservation duties, exercise or defend legal rights, enforce Textority terms, and meet payment, tax, accounting, fraud, safety, and regulatory obligations.

6.10 Corporate and business operations. We may use information for internal administration, auditing, accounting, risk management, business planning, corporate transactions, and other legitimate business operations consistent with this Privacy Policy and applicable law.

6.11 Materially different purposes. If Textority proposes to use personal information for a materially different purpose that requires new notice, consent, or authorization under applicable law, Textority will provide that notice or obtain that consent or authorization before the new use when required.

7. CREATORS, AUDIENCE DATA, AND USER-TO-USER PRIVACY

7.1 Information made available to Creators. When an End User interacts with a Creator or purchases, enrolls in, accesses, or requests a Creator Offering, the Creator and authorized Creator Team Members may receive information reasonably necessary for the interaction, fulfillment, support, transaction, or other function the User requests. The categories made available depend on the feature and transaction.

7.2 Communications. When you communicate with a Creator through the Services, the Creator and authorized Creator Team Members may receive the content of the communication and related account or conversation information necessary to participate in or administer that interaction.

7.3 Creator privacy responsibilities. A Creator that independently determines how to use audience or customer information is responsible for its own notices, consents, legal bases or authorizations, security, retention, marketing practices, and data-subject rights to the extent applicable law places those obligations on the Creator.

7.4 No unrelated use. Access to information through Textority does not authorize a Creator or other User to sell, disclose, export, enrich, profile, or use that information for unrelated purposes in violation of the Creator Terms, applicable Textority policies, a User’s choices, or applicable law.

7.5 Public information. Information you choose to publish to a public Channel, profile, listing, or other public-facing feature can be viewed by other people. Do not publish information that you do not want to make public.

8. PAYMENTS, VERIFICATION, AND COMMERCE DATA

8.1 Payment Providers. Textority may use third-party Payment Providers for payment acceptance, tokenization, authentication, fraud screening, identity or business verification, settlement, refunds, disputes, payouts, sanctions screening, tax support, or related services. Payment Providers process information under their own agreements and privacy notices where applicable.

8.2 Payment credentials. The payment architecture may differ by transaction and provider configuration. This Privacy Policy does not represent that Textority stores full card or bank credentials, and it does not represent that Textority never receives payment-related information. The applicable provider and payment flow determine what payment information is processed by each participant.

8.3 Verification. Textority or a service provider may request information reasonably necessary to verify identity, business ownership, account authority, payout eligibility, professional status, age, guardianship, sanctions status, fraud risk, or another eligibility requirement. Verification confirms only the information and purpose of the check performed.

8.4 Transaction records. We may retain records reasonably necessary to document checkout disclosures, authorization, payment status, refunds, disputes, payouts, acceptance, delivery, access, and other transaction events, subject to applicable retention and privacy requirements.

9. TEXTORITY AI AND AUTOMATION

9.1 Inputs and outputs. Textority AI and automation features may process User Content, messages, prompts, instructions, knowledge sources, configurations, transaction context, and other information supplied or made available to the feature to generate or route outputs and perform supported functions.

9.2 AI service providers. Where Textority uses an external model or AI service provider, information may be transmitted to that provider as necessary for the enabled feature, subject to the applicable provider arrangement, Textority terms, and law.

9.3 Model training and improvement. This Privacy Policy does not make a blanket promise that User Content is never used for model training or improvement, and it does not state that all User Content is used for those purposes. Any material use of personal information for training or improvement is governed by the applicable feature, provider arrangement, settings, and AI notice or Additional Terms made available for that use.

9.4 AI limitations. AI outputs may be inaccurate, incomplete, outdated, biased, or otherwise unsuitable. Privacy-sensitive or regulated decisions should not be made solely from an AI output unless the feature and applicable law expressly support that use.

9.5 Significant automated decisions. Textority does not use this Privacy Policy to claim that current AI features make decisions producing legal or similarly significant effects about individuals. If Textority introduces covered automated decision-making, Textority will provide any notice, assessment, consent, opt-out, or other protection required by applicable law.

10. COOKIES, ANALYTICS, AND SIMILAR TECHNOLOGIES

10.1 Website and Service technologies. Textority may use browser or device logs and, where enabled, cookies or similar technologies to operate the Services, maintain security, remember preferences, understand usage, measure performance, and support analytics.

10.2 Analytics. Textority may use analytics or product-measurement tools where operationally enabled. This Privacy Policy does not identify a particular analytics provider, cookie duration, advertising purpose, or tracking technology unless Textority has confirmed that practice for the Services.

10.3 Choices and consent. Where applicable law requires consent or an opt-out for a cookie, analytics practice, targeted advertising practice, sale or sharing of personal information, or similar technology, Textority will provide the applicable choice through a consent tool, preference control, or other lawful mechanism.

10.4 Cookie Policy. A separate Textority Cookie Policy provides additional information about cookie and similar-technology practices that Textority has actually enabled, including available controls.

11. WHEN WE DISCLOSE PERSONAL INFORMATION

11.1 Service providers. We may disclose personal information to vendors and service providers that support hosting, infrastructure, communications, analytics, customer support, security, fraud prevention, verification, payments, AI, professional services, or other functions for Textority. Access should be limited to what is reasonably necessary for the service and subject to applicable contractual and legal requirements.

11.2 Creators and other Users. We disclose information to Creators, Creator Team Members, buyers, End Users, guardians, or other Users when reasonably necessary to provide an interaction, transaction, team function, support process, report, or other User-directed feature, or when the User intentionally makes information public.

11.3 Payment and transaction participants. We may disclose information to Payment Providers, financial institutions, payment networks, payout providers, tax or verification providers, and other transaction participants as reasonably necessary to authorize, process, settle, refund, dispute, verify, or support a transaction.

11.4 Legal, safety, and compliance disclosures. We may preserve or disclose information when reasonably necessary and permitted or required by law, including in response to valid legal process, court orders, regulatory requests, preservation obligations, legally required reports, or a good-faith emergency involving imminent danger. Where legally required, this may include reports to child-safety or other designated authorities.

11.5 Professional advisers. We may disclose information to lawyers, auditors, accountants, insurers, investigators, consultants, or other professional advisers where reasonably necessary for legal, compliance, risk, business, or professional-services purposes and subject to appropriate duties or restrictions.

11.6 Corporate transactions. Personal information may be disclosed or transferred in connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, corporate transition, or similar transaction, subject to applicable law and appropriate protections.

11.7 With your direction or consent. We may disclose information when you direct us to do so, use a feature designed to disclose information to another party, connect a third-party service, or otherwise provide consent or authorization where required.

11.8 Legal meaning of sale or sharing. Terms such as “sell,” “sale,” “share,” “sharing,” and “targeted advertising” may have specific meanings under state privacy laws. Whether a particular disclosure falls within one of those definitions depends on the applicable law and the facts. If Textority engages in processing that triggers a legally required disclosure or opt-out, Textority will provide the required notice and choice.

12.1 Safety and integrity. Textority may use personal information to investigate and act on suspected fraud, abuse, prohibited activity, infringement, impersonation, unauthorized access, harmful conduct, security incidents, or other violations of Textority terms or law.

12.2 Reports. Information submitted through a report or complaint may be shared with the reported User, Creator, service provider, authority, or other relevant participant when reasonably necessary to investigate, provide due process, enforce rules, protect safety, or comply with law. Textority may withhold information where disclosure would create a safety, legal, privacy, security, or integrity risk.

12.3 Preservation. Textority may preserve information for a period permitted or required by law when reasonably necessary for litigation, investigations, disputes, fraud prevention, child-safety reporting, valid preservation requests, or other legal or safety obligations.

12.4 No general monitoring promise. Textority does not represent that it continuously monitors all private communications or every item of User Content. Textority may use reports, metadata, automated systems, human review, or other lawful methods to identify and address safety, security, abuse, or compliance issues where appropriate.

13. DATA RETENTION AND DELETION

13.1 No universal retention period. Textority does not promise one retention period for every category of personal information. Retention depends on the nature of the information, the purpose for which it is processed, account status, transaction and support needs, safety and fraud risks, legal obligations, dispute and enforcement needs, and applicable law.

13.2 General retention approach. We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy or another applicable notice, and for additional periods when reasonably necessary to establish, exercise, or defend legal claims; maintain transaction, tax, accounting, fraud, safety, or security records; comply with law; or satisfy valid preservation obligations.

13.3 Deletion and deidentification. When personal information is no longer reasonably necessary and no legal or operational reason requires continued retention, Textority may delete, deidentify, aggregate, or otherwise remove the information from active use, subject to applicable law and technical limitations.

13.4 Backups and residual copies. Deletion from an active account or production system may not immediately remove information from backups, security records, legal holds, archived transaction records, or other systems where continued retention is reasonably necessary or required. Residual information remains subject to applicable protections until it is deleted, deidentified, overwritten, or otherwise no longer retained.

13.5 Age-verification information. If Textority uses information specifically for age or guardian verification, Textority will limit its use and retention as required by applicable law and the verification method used.

13.6 Colombia database duration. For processing subject to Colombia’s general personal-data regime, databases covered by this Privacy Policy remain in operation while Textority provides the Services and while the applicable processing purposes remain valid, together with any additional period required or permitted for legal, contractual, transaction, safety, accounting, dispute, or compliance purposes. Textority does not treat this statement as authorization for indefinite retention without a continuing purpose.

14. SECURITY

14.1 Safeguards. Textority uses safeguards that it considers reasonable and appropriate for the Services and the information at issue and expects service providers handling personal information to meet applicable confidentiality, security, and contractual requirements.

14.2 No absolute security guarantee. No online service can guarantee absolute security, confidentiality, availability, or freedom from unauthorized access. This Privacy Policy does not represent that communications are end-to-end encrypted, that Textority can never access User Content, that deletion is instantaneous or irreversible, or that the Services are perfectly secure.

14.3 User responsibilities. Users should protect credentials, use available account-security features responsibly, limit team permissions appropriately, and promptly report suspected unauthorized access or misuse.

14.4 Security incidents. If a security incident triggers a legally required notice to affected individuals, regulators, or other parties, Textority will provide notice in accordance with the applicable legal requirements.

15. CHILDREN, TEEN USERS, AND GUARDIANS

15.1 Children under 13. The Services are not directed to children under 13, and children under 13 may not create an account or use interactive Services intended for account holders. If Textority obtains actual knowledge that it has collected personal information online from a child under 13 in circumstances governed by the Children’s Online Privacy Protection Act or another applicable child-privacy law, Textority will take the steps required by that law.

15.2 Teen Users. An End User who is at least 13 and under 18 may use the Services only under the age and guardian framework in the Terms of Service. Teen Users may not operate Channels, sell Creator Offerings, receive payouts, or hold adult-only administrative roles described in the Terms of Service.

15.3 Guardians. Textority may process guardian identity, contact, authorization, transaction, or verification information where reasonably necessary to administer a Teen User’s use, purchase, safety, or legal rights. A guardian may exercise rights for a minor when applicable law permits or requires it.

15.4 Age and guardian verification. Textority may request reasonable evidence of age, identity, guardianship, or authorization where necessary for a feature, safety review, legal obligation, or age-related restriction. Textority does not use this Privacy Policy to promise a particular age-assurance technology or method.

15.5 Colombia minors. Where Colombia’s personal-data rules apply to information concerning children or adolescents, Textority will apply the legally required protections and will prioritize their rights and best interests. Any authorization or processing condition required by applicable law must be satisfied before the covered processing occurs.

16. YOUR PRIVACY RIGHTS AND REQUESTS

16.1 Rights vary by jurisdiction. Depending on where you live and which privacy law applies to Textority, you may have rights to request access to or confirmation of personal information, correction, deletion, portability, information about processing or disclosures, withdrawal of consent, objection or opt-out, restriction, or appeal of certain privacy decisions.

16.2 Account controls. Where available, you may be able to update certain account, profile, communication, or privacy information directly through the Services. A self-service change does not replace a statutory request where applicable law provides additional rights.

16.3 Submitting a request. You may submit a privacy request through a privacy or account tool Textority makes available or by contacting hello@textority.com. Please describe the right you want to exercise and provide information reasonably necessary to identify the relevant account or processing activity.

16.4 Verification. To protect personal information, Textority may take reasonable steps to verify identity, authority, guardianship, or agency before fulfilling a request. Textority will not require unrelated or disproportionate information solely to make a privacy request harder to exercise.

16.5 Authorized agents and representatives. Where applicable law allows a request through an authorized agent, representative, guardian, or other person, Textority may request evidence of that person’s authority and may verify the identity of the person whose information is involved to the extent permitted by law.

16.6 Exceptions. Privacy rights may be subject to legal exceptions, including where information must be retained for security, fraud prevention, legal compliance, transactions, disputes, tax or accounting, free expression, establishment or defense of legal claims, or another purpose recognized by applicable law.

16.7 Response and appeals. Textority will respond within the period required by applicable law. Where applicable law provides a right to appeal a denial or partial denial, Textority will provide the appeal method required by that law.

17. U.S. STATE PRIVACY RIGHTS

17.1 Threshold-based laws. Several U.S. states provide comprehensive privacy rights only when statutory thresholds, definitions, residency requirements, and other conditions are met. Textority does not claim that every state privacy statute applies to Textority merely because a resident of that state can access the Services.

17.2 Covered rights. Where an applicable U.S. state privacy law covers Textority and the relevant processing, rights may include access or confirmation, correction, deletion, data portability, information about categories of data and recipients, and the right to appeal certain privacy-request decisions.

17.3 Sensitive data. Where an applicable state law requires consent or another specific condition before processing covered sensitive data, Textority will apply that requirement to the processing within the scope of that law.

17.4 Sale, targeted advertising, and profiling. Where applicable law gives a right to opt out of the sale of personal data, targeted advertising, sharing for cross-context behavioral advertising, or profiling in furtherance of decisions producing legal or similarly significant effects, Textority will provide the legally required opt-out for processing that falls within that definition and scope.

17.5 Universal opt-out signals. Where applicable law requires Textority to recognize a legally valid universal opt-out preference signal and the signal applies to the processing at issue, Textority will process the signal as required by that law.

17.6 Non-discrimination. Textority will not unlawfully discriminate against a person for exercising an applicable privacy right.

18. COLOMBIA PERSONAL-DATA NOTICE AND RIGHTS

18.1 Applicable framework. Where Colombia’s general personal-data regime applies, Textority processes personal data in accordance with applicable Colombian law, including Law 1581 of 2012 and its regulatory framework. This Section supplements the rest of this Privacy Policy for covered processing.

18.2 Responsable del Tratamiento. For personal data for which Textority determines the purposes and means of processing under Colombian law, Textority Inc. acts as Responsable del Tratamiento. A Creator or other party may separately act as a Responsable or Encargado for processing that party controls or performs, depending on the actual activity and applicable law.

18.3 Authorization. Where Colombian law requires prior, express, and informed authorization, Textority will request that authorization through the applicable collection or feature flow. This Privacy Policy provides notice of general practices but does not replace a separate authorization where the law requires one.

18.4 Purposes. The categories and purposes described in Sections 4 through 12 apply to Colombian personal data only to the extent they are relevant to the individual’s use of the Services and are permitted by the applicable authorization or another lawful exception.

18.5 Sensitive data. Where Colombian law classifies information as sensitive, providing that information is voluntary unless a specific legal or operational requirement lawfully makes it necessary for a requested feature or relationship. Textority will not condition an unrelated service on optional sensitive information where doing so would be inconsistent with applicable law.

18.6 Rights of Colombian data subjects. Subject to applicable law, a Titular may know, update, and rectify personal data; request proof of authorization where applicable; request information about the use of personal data; access personal data free of charge as provided by law; submit complaints to the Superintendencia de Industria y Comercio after satisfying applicable procedural requirements; and request revocation of authorization or deletion where legally available and no legal or contractual duty requires continued retention.

18.7 Consultations. A Colombia privacy request that is a consultation regarding personal data will be handled within the period required by Article 14 of Law 1581 of 2012, currently up to ten business days from receipt, with the legally permitted extension when necessary and properly communicated.

18.8 Claims. A Colombia privacy request seeking correction, updating, deletion, revocation, or alleging noncompliance will be handled as a claim under the procedure required by applicable law. A complete claim is generally subject to the fifteen-business-day response period in Article 15 of Law 1581 of 2012, with the legally permitted extension when necessary and properly communicated.

18.9 Complaint to the SIC. Where Law 1581 requires exhaustion of the consultation or claim process before a complaint to the Superintendencia de Industria y Comercio, the Titular should first submit the applicable request to Textority using the contact method in Section 24.

18.10 Transfers and transmissions. Where Colombian law regulates an international transfer or transmission of personal data, Textority will use the applicable legal mechanism and contractual or other safeguards required for the relevant relationship. This Privacy Policy does not state that all Textority data is stored in any particular country.

18.11 Additional Colombia notice. Textority may provide a separate Colombia privacy notice or authorization for a collection point, product, or processing activity where additional information, consent, or locally specific disclosure is required.

19. INTERNATIONAL PROCESSING AND DATA TRANSFERS

19.1 Processing locations. Depending on the applicable service and provider configuration, personal information may be processed outside the individual’s state or country. This Privacy Policy does not identify or promise a particular data-center, hosting, or storage location unless Textority has confirmed that location.

19.2 Applicable transfer requirements. Where a law requires a contract, authorization, adequacy condition, transfer mechanism, transmission agreement, or other safeguard for cross-border processing, Textority will use the mechanism applicable to the processing at issue.

19.3 Future jurisdictions. If Textority later targets additional jurisdictions that require supplemental notices or transfer terms, Textority may provide Regional Terms or privacy notices before or when those requirements become applicable.

20.1 External services. The Services may permit links to or interactions with Creator websites, Payment Providers, social platforms, communications providers, external content, or other third-party services. Textority does not control the independent privacy practices of those third parties.

20.2 Third-party terms. A third party may collect or receive personal information under its own privacy notice, terms, permissions, and settings. Review those materials before providing information to the third party.

20.3 Integrations. If Textority enables an integration, information is exchanged only according to the integration functionality, permissions, and applicable notices or agreements. Availability of an integration does not mean Textority endorses the third party’s independent privacy practices.

21. COMMUNICATIONS AND MARKETING CHOICES

21.1 Service and transaction communications. Textority may send communications reasonably necessary for account administration, security, transactions, subscriptions, support, policy updates, legal notices, and operation of the Services. Some operational communications cannot be opted out of while the underlying account, transaction, or feature remains active.

21.2 Marketing email. If Textority sends marketing or promotional email, you may use the unsubscribe method provided in the communication or another preference method Textority makes available. An unsubscribe from marketing does not stop required service, legal, security, or transaction communications.

21.3 Creator communications. A Creator may send or initiate communications through the Services only as permitted by Textority terms and applicable law. A Creator that independently uses contact information for its own marketing is responsible for the consent, notice, opt-out, suppression, and other obligations that apply to that use.

21.4 SMS and other regulated channels. Textority does not treat acceptance of this Privacy Policy as consent to receive marketing text messages, automated calls, or other communications for which applicable law requires separate consent.

21.5 SMS Authentication and Mobile Opt-In Data. When a User requests a one-time verification code by SMS, Textority may process the mobile phone number, verification request, consent-related records, message delivery information, and related security data as reasonably necessary to authenticate the User, deliver the requested message, prevent unauthorized access, and maintain the security and integrity of the Services.

Textority does not sell, rent, or share SMS opt-in data or text messaging consent with third parties or affiliates for their independent use, marketing, or promotional purposes. Textority may engage contracted communications and infrastructure service providers to process the limited information necessary to deliver, secure, and support User-requested verification messages on Textority’s behalf, subject to applicable confidentiality, security, and contractual protections. Such providers are not authorized to use the information for their own marketing purposes.

SMS authentication consent is obtained through the applicable User-initiated verification process and is separate from any consent required for marketing or promotional communications. Textority does not use enrollment in its SMS authentication program as authorization to send promotional text messages.

22. ACCOUNT CLOSURE AND DELETION REQUESTS

22.1 Closing an account. Closing or terminating an account may stop ordinary account use but does not necessarily require immediate deletion of every record associated with the account.

22.2 Deletion requests. A User may request deletion of personal information as described in Section 16. Textority will delete information when required by applicable law and may retain information where an exception or continuing legal, transaction, safety, fraud, security, tax, accounting, dispute, or preservation need applies.

22.3 Creator and buyer obligations. Account closure does not automatically erase records necessary to address existing Creator Offering obligations, purchased access, refunds, disputes, chargebacks, taxes, safety reports, or other accrued matters.

23. CHANGES TO THIS PRIVACY POLICY

23.1 Prospective changes. Textority may update this Privacy Policy prospectively to reflect changes in law, the Services, data practices, providers, or business operations.

23.2 Material changes. Where applicable law or the nature of a change requires advance notice, Textority will provide reasonable notice through the Services, by email, or by another appropriate method before the material change applies to existing Users.

23.3 New consent or authorization. If a change introduces a materially different processing purpose for which applicable law requires new consent or authorization, Textority will obtain that consent or authorization before applying the new purpose to covered personal information.
