6. WHAT HAPPENS NEXT
6.1 Forwarding. If the counter-notice substantially satisfies the statutory requirements and the DMCA counter-notice process applies, Textority will promptly provide a copy to the person who submitted the original notice.
6.2 Restoration window. If the statutory requirements are satisfied and Textority does not timely receive notice of a qualifying court action or other proceeding that legally prevents restoration, Textority will replace the removed material or cease disabling access not less than ten (10) and not more than fourteen (14) business days after receipt of the compliant counter-notice, subject to applicable law and independent Textority policy grounds.
6.3 Separate grounds. A DMCA counter-notice does not require Textority to restore material that is independently prohibited by law, court order, the Terms of Service, Acceptable Use Policy, Community and Content Rules, Prohibited Products and Services Policy, or another applicable Textority rule.
6.4 Information sharing. The DMCA process requires a compliant counter-notice to be provided to the person who submitted the original notice. The contact information and statements in this form may therefore be disclosed to that person or that person’s agent.
6.5 Legal advice. Textority cannot advise you whether your use is licensed, fair use, public domain, or otherwise lawful. Consider obtaining independent legal advice if you are uncertain whether to submit a counter-notice.
PART IV. TEXTORITY REPEAT COPYRIGHT INFRINGER POLICY
This Repeat Copyright Infringer Policy applies to subscribers and account holders who use textority.com, text.me, text.to, lets.talk, the Textority platform, and other Textority services that incorporate this Policy.
1. PURPOSE AND RELATIONSHIP TO OTHER TERMS
1.1 Purpose. Textority respects copyright and maintains a policy providing for termination, in appropriate circumstances, of subscribers and account holders who are repeat copyright infringers.
1.2 Related documents. This Policy supplements the Textority Terms of Service, Intellectual Property Policy, DMCA Policy, Acceptable Use Policy, Community and Content Rules, and other applicable Textority terms.
1.3 No fixed strike entitlement. Nothing in this Policy gives a User a right to receive a particular number of warnings or infringement events before Textority may restrict or terminate an account when independent grounds justify earlier action.
2. MATTERS TEXTORITY MAY CONSIDER
2.1 Relevant evidence. Textority may consider reliable copyright matters associated with an account, Channel, User, or coordinated set of accounts, including effective DMCA notices, repeated re-uploading, evasion of prior removals, court orders, adjudications, settlements, admissions, and other reasonably reliable evidence of infringement.
2.2 Context. Textority may consider the number, timing, subject matter, similarity, credibility, and resolution of copyright matters and whether the conduct indicates a pattern of infringement rather than an isolated or disputed event.
2.3 Associated accounts. Textority may consider accounts or Channels that are reasonably linked and used to continue or evade copyright enforcement, subject to applicable law and reasonable evidence.
3. MATTERS THAT MAY NOT SUPPORT REPEAT-INFRINGER TREATMENT
Textority may decline to count or may remove weight from an allegation when reliable information shows that it should not support repeat-infringer treatment, including where a notice was materially deficient, the claimant withdrew the allegation, a compliant counter-notice resulted in restoration without a timely qualifying proceeding, a competent authority determined that infringement did not occur, or the allegation resulted from clear mistake or misidentification.
4. ENFORCEMENT MEASURES
4.1 Proportionate action. Depending on the circumstances, Textority may remove or disable material, issue warnings, restrict uploading or other features, suspend an account or Channel, terminate an account or Channel, restrict associated accounts used to evade enforcement, preserve relevant records, or take other lawful and proportionate action.
4.2 Appropriate circumstances. Termination may be appropriate where the available evidence demonstrates repeated copyright infringement, deliberate re-uploading or circumvention, continued infringement after prior action, or another pattern that makes continued access inconsistent with Textority’s copyright obligations or platform integrity.
4.3 Egregious conduct. Textority may act immediately when conduct independently warrants suspension or termination under law, a court order, the Terms of Service, fraud or security rules, or another Textority policy. Textority is not required to wait for repeated DMCA notices in those circumstances.
5. COUNTER-NOTICES, WITHDRAWALS, AND CORRECTIONS
5.1 Counter-notices. Textority will consider the procedural status and result of a DMCA counter-notice when determining whether a matter supports repeat-infringer treatment.
5.2 Withdrawals. If a claimant withdraws a copyright allegation or provides reliable information showing that the matter has been resolved, Textority may update its enforcement record accordingly.
5.3 Corrections. Textority may correct internal infringement records where reliable information shows that an allegation was associated with the wrong account, wrong material, or otherwise should not have been attributed to the User.
6. EVASION AND RE-UPLOADING
A User may not evade copyright enforcement by creating or using another account, changing a username or Channel, moving substantially the same material to another Textority location, directing another person to re-upload removed material, or using another feature to continue conduct that Textority validly restricted. Evasion may itself support additional enforcement.
7. STANDARD TECHNICAL MEASURES
Where 17 U.S.C. § 512(i) applies, Textority will evaluate and accommodate qualifying standard technical measures and will not knowingly interfere with them in a manner prohibited by law. This Policy does not represent that any particular fingerprinting, filtering, hashing, rights-management, or automated copyright system is currently deployed.
8. REVIEW AND RECORDS
8.1 Review. Where Textority offers a review or appeal process for a copyright enforcement decision, a User may use that process subject to applicable eligibility and timing requirements. A review does not automatically restore material or account access.
8.2 Records. Textority may retain records reasonably necessary to administer copyright notices, counter-notices, repeat-infringer decisions, disputes, legal holds, fraud prevention, and legal compliance, subject to applicable privacy and retention requirements.
8.3 No final adjudication. Textority’s decision to remove, restore, restrict, suspend, or terminate does not finally adjudicate copyright ownership or infringement between private parties.
9. NO SAFE-HARBOR GUARANTEE
This Policy is intended to support Textority’s copyright compliance. It does not represent or guarantee that Textority qualifies for any particular limitation on liability or safe harbor in every circumstance. Applicability depends on the statutory requirements, Textority’s actual practices, and the facts of the matter.
