TEXTORITY DIGITAL CONTENT DELIVERY AND ACCESS POLICY
Last Updated: September 30, 2026
This Digital Content Delivery and Access Policy (the “Policy”) applies to Digital Content and digital access made available through textority.com, text.me, text.to, lets.talk, the Textority web platform, and related online services operated by Textority Inc. (“Textority,” “we,” “us,” or “our”). It supplements the Textority Terms of Service and other applicable Additional Terms.
1. PURPOSE AND SCOPE
1.1 What this Policy covers. This Policy governs delivery and access for Digital Content made available through the Services, including delivery methods, access periods, expiration, downloads, hosted or streamed access, courses and libraries, staged releases, delivery failures, inaccessible content, purchased-access continuity, content removal, and records relating to delivery and access.
1.2 Paid and free content. Some provisions apply only to paid Creator Offerings or purchased access. Other provisions may also apply to free Digital Content where the context requires.
1.3 Digital Content only. This Policy principally governs Digital Content. Creator Services, including consultations, coaching, appointments, live professional services, and other performed services, are governed by the terms applicable to those services. A Creator Offering may contain both Digital Content and Creator Services, in which case each component is evaluated under the rules applicable to that component.
1.4 Matters governed elsewhere. Refund eligibility and refund amounts are governed by the Refund and Cancellation Policy. Recurring billing and cancellation are governed by the Subscription and Auto-Renewal Terms. Payment authorization and transaction mechanics are governed by the Payment Terms. Creator balances and payouts are governed by the Creator Payout Terms. Chargebacks and external payment disputes are governed by the Chargeback and Payment Dispute Policy. Creator eligibility and fulfillment duties are governed by the Creator Terms. Prohibited and restricted categories are governed by the Prohibited Products and Services Policy.
1.5 No physical goods. This Policy does not govern physical goods or shipping. Physical goods are not supported unless Textority later expressly enables them under updated terms.
2. RELATIONSHIP TO OTHER TEXTORITY TERMS
2.1 Additional Terms. This Policy is Additional Terms under the Terms of Service and applies together with the Terms of Service, applicable Creator Terms, Transaction Terms, Creator Policies, and other Additional Terms.
2.2 Specific subject matter. This Policy controls for Digital Content delivery and access to the extent it addresses that subject specifically. It does not override another document within that document’s specific subject matter.
2.3 Transaction Terms. The material delivery, access, license, refund, recurring, and other terms presented for a particular purchase form part of the Transaction Terms for that purchase, subject to the order of precedence in the Terms of Service and mandatory law.
2.4 Mandatory law. Nothing in this Policy limits a non-waivable consumer right, statutory warranty, payment right, intellectual-property right, or other mandatory protection.
3. PARTIES, ROLES, AND APPLICATION
3.1 Textority. Textority Inc. provides the technology through which Creators may make Digital Content available and End Users may obtain access. Depending on the transaction and configuration, Textority may also provide or administer checkout, payment, delivery, access, transaction records, or support tooling.
3.2 Creator. The Creator is responsible for the Creator Content and Creator Offering, including the accuracy of the listing, rights to the content, promised components, delivery commitments, access duration, material technical requirements, and buyer support, except to the extent Textority expressly assumes a specific obligation.
3.3 Seller and payment roles. The contracting seller, merchant of record, payment recipient, supplier, and payment provider for a paid Creator Offering are determined by the applicable checkout, receipt, Payment Terms, Transaction Terms, and provider configuration. This Policy does not designate Textority as merchant of record or contracting seller for every transaction.
3.4 Service providers. Hosting, storage, streaming, delivery, security, payment, and other service providers do not become the owner or licensor of Creator Content merely because they support the Services.
3.5 Team members. A Creator Team Member does not become the Creator, seller, licensor, or payout recipient merely because the person receives assigned access to a Channel.
4. ACCEPTANCE AND EXERCISING RIGHTS
4.1 Acceptance. This Policy applies when it is incorporated into or presented as part of the terms governing the relevant Digital Content, account, Creator Offering, or transaction.
4.2 Exercising a right is not new acceptance. Reporting a delivery problem, seeking restoration, requesting a Refund, cancelling a Subscription, disputing a charge, submitting a complaint, or exercising a legal right does not by itself constitute new acceptance of this Policy or waive an existing right.
4.3 Existing transaction terms remain applicable. Properly accepted terms for an existing transaction continue to apply according to their terms, subject to mandatory law.
5. DEFINITIONS
Capitalized terms not defined here have the meanings given in the Terms of Service and applicable Additional Terms.
“Access” means an End User’s authorized ability to reach or use Digital Content during the applicable Access Period.
“Access Period” means the period during which an End User is entitled to access particular Digital Content through the Services, as disclosed for the Creator Offering.
“Delivery” means making the promised Digital Content or component available through the delivery method applicable to the transaction.
“Delivery Record” means a record, where actually created and retained, that is reasonably relevant to whether a delivery event occurred.
“Digital Content” has the meaning in the Terms of Service and includes electronically delivered materials such as text, images, audio, video, files, courses, lessons, templates, downloads, recordings, digital guides, and membership content. Digital Content does not include physical goods.
“Entitlement” means a record or status indicating that a User is permitted to access specified Digital Content under the applicable terms.
“Immediate Digital Delivery” means Digital Content made available promptly after the condition for delivery stated in the Transaction Terms is satisfied.
“Non-Delivery” means failure to make promised Digital Content available by the time or condition required by the applicable Transaction Terms or mandatory law.
6. DELIVERY AND ACCESS ARCHITECTURE
6.1 What was promised governs. Delivery is measured against the Creator Offering description, checkout disclosures, Access Period, Creator Policies, and other Transaction Terms that applied when the End User obtained the Digital Content.
6.2 Delivery is not the same as use. Making Digital Content available, granting an Entitlement, opening a file, downloading a file, streaming content, and completing content are distinct events. Evidence of one does not automatically establish another.
6.3 Component-level analysis. Where a Creator Offering contains multiple files, modules, lessons, releases, services, or other components, delivery and access may be assessed component by component.
6.4 No universal delivery method. This Policy does not require one technical delivery method for every Creator Offering. A delivery method applies only if the Services actually support it and it is used for the relevant offering.
6.5 No universal service level. Unless expressly stated in the applicable Transaction Terms, Textority does not promise a universal uptime percentage, download speed, streaming resolution, device list, browser list, bandwidth threshold, or delivery service level.
7. PRE-PURCHASE DELIVERY AND ACCESS DISCLOSURES
7.1 Material information. Before a paid Digital Content purchase is completed, material information should be disclosed where applicable, including what is included, the delivery method, delivery timing or release conditions, Access Period, expiration, recurring nature, material technical requirements, and material license limitations.
7.2 Accuracy. A Creator must not advertise immediate delivery, lifetime access, permanent access, specific compatibility, downloadable files, future modules, future updates, or another material delivery or access feature unless the representation is accurate and supportable.
7.3 Clear online disclosures. A material qualification needed to avoid a misleading online claim must be presented clearly and conspicuously in the applicable offer or checkout flow.
7.4 Transaction version. A Creator may change a current listing prospectively, but may not use a later listing change to retroactively reduce a completed buyer’s purchased access, remove promised components, or change the material license terms that governed the purchase, except where applicable law or the original Transaction Terms permit the change.
8. CREATOR DELIVERY AND SUPPORT RESPONSIBILITIES
8.1 Fulfillment. A Creator must provide Digital Content according to the material delivery method, timing, components, access duration, and technical requirements disclosed for the Creator Offering.
8.2 Rights. A Creator must own or have the rights, permissions, licenses, and consents necessary to upload, display, sublicense where applicable, and deliver Creator Content through the Services.
8.3 Support. A Creator must provide reasonable support for Creator-controlled delivery and access issues and cooperate with Textority concerning complaints, Refunds, payment disputes, safety issues, and legal requests relating to the Creator Offering.
8.4 No evasion by deletion. A Creator may not close a Channel, delete content, alter an offering, or terminate an account for the purpose of evading an existing fulfillment or purchased-access obligation.
8.5 Creator-controlled external delivery. If Textority permits a Creator to use an external delivery location or third-party service, the Creator remains responsible for any delivery or access commitment the Creator made, except to the extent the applicable Transaction Terms expressly allocate responsibility otherwise.
9. TEXTORITY DELIVERY AND ACCESS TOOLING
9.1 Platform functions. Textority may provide technical tools to host, store, transmit, display, release, restrict, restore, or otherwise make Digital Content accessible.
9.2 Scope of responsibility. Providing delivery or access tooling does not by itself transfer the Creator’s substantive fulfillment obligations to Textority. Textority remains responsible for obligations it expressly assumes and for obligations imposed on it by applicable law.
9.3 Platform-caused failures. If a confirmed Textority-controlled system error materially prevents delivery or access that Textority was responsible for providing, Textority may take reasonable corrective action and will provide any remedy required by applicable law or the governing terms.
9.4 Third-party dependencies. Textority may rely on service providers. A third-party outage or failure does not automatically eliminate an obligation that applicable law or the governing Transaction Terms place on Textority or the Creator.
10. OWNERSHIP AND LICENSES
10.1 Creator ownership. As between Textority and the Creator, the Creator retains ownership of Creator Content, subject to third-party rights and the licenses granted under the governing terms.
10.2 Textority operating license. The Creator grants Textority the rights described in the Terms of Service to host, store, process, transmit, display, technically adapt, secure, and make Creator Content available as reasonably necessary to operate the Services and fulfill authorized access.
10.3 End User license. An End User receives only the license or usage rights applicable to the Creator Offering. Unless broader rights were clearly granted, purchasing or accessing Digital Content does not transfer copyright or ownership of the content.
10.4 Technical capability is not permission. The technical ability to download, copy, screenshot, record, extract, or share Digital Content does not by itself authorize that activity beyond the governing license or applicable law.
10.5 Purchased-access support. To the extent necessary and lawful, the Creator’s authorization to Textority may continue after Creator Content is deleted or a Channel ends for the limited purpose of honoring unexpired purchased access, maintaining lawful records, resolving disputes, and complying with legal obligations.
11. ACCESS PERIODS AND EXPIRATION
11.1 Disclosed duration. Where access is time-limited, the applicable Access Period or method for determining it must be disclosed before purchase where material.
11.2 Access periods may differ. A Creator Offering may provide fixed-term, subscription-based, release-based, or another clearly disclosed form of access supported by the Services.
11.3 No universal lifetime access. This Policy does not create a default right to lifetime or permanent access. A Creator must not use “lifetime,” “permanent,” or similar language without accurately describing the duration and material limits of the promise.
11.4 Expiration. Ordinary expiration at the end of a clearly disclosed Access Period is not Non-Delivery merely because hosted access later ends.
11.5 Local copies. Ending hosted access does not necessarily delete a lawfully downloaded local copy. Continued use of a local copy remains subject to the applicable license and law.
12. DELIVERY METHODS
12.1 Supported methods. Digital Content may be delivered through a method actually supported for the relevant Creator Offering, such as account-based access, a content library, hosted access, streaming, download, a Textority-generated link, or another disclosed method.
12.2 No feature created by this Policy. Listing a possible delivery method in this Policy does not mean that Textority currently supports that method for every Creator or Creator Offering.
12.3 Delivery destination. Delivery is made to the account, Channel, address, link, library, or other destination identified by the applicable transaction or access flow.
12.4 External destinations. Where permitted, a material dependency on an external account, link, host, player, or platform should be disclosed before purchase if it can materially affect ordinary access.
13. IMMEDIATE DIGITAL DELIVERY
13.1 Immediate access. Where the Transaction Terms provide for Immediate Digital Delivery, the content should be made available promptly after the disclosed delivery condition is satisfied.
13.2 Payment conditions. If delivery is conditioned on successful payment, authorization, verification, settlement status, or another disclosed condition, access may be delayed or restricted according to the governing Payment Terms and Transaction Terms.
13.3 Delivery does not prove consumption. Immediate Digital Delivery establishes only that access was made available. It does not by itself prove that an End User opened, viewed, downloaded, completed, or benefited from the content.
13.4 Consumer rights. Immediate delivery, access, download, or consumption does not by itself make a transaction universally final or non-refundable. Any effect on a right of withdrawal, cancellation, or Refund depends on the Refund and Cancellation Policy and applicable law.
14. SCHEDULED, STAGED, DRIP, OR RELEASE-BASED DELIVERY
14.1 Disclosed schedule governs. Where a Creator Offering is delivered in stages, the disclosed release dates, sequence, milestones, or release conditions govern.
14.2 Future components. A component is not Non-Delivery merely because its disclosed future release date or condition has not yet arrived.
14.3 Missed release. Failure to deliver a component when it is due may constitute delayed or partial delivery and may support a remedy under the applicable Transaction Terms, Refund and Cancellation Policy, or law.
14.4 Schedule changes. A Creator may not materially postpone or remove a promised component for an existing purchase merely by changing the current listing. A lawful modification, agreed substitute, or other change may apply where the governing terms and law permit it.
15. DOWNLOADABLE DIGITAL CONTENT
15.1 Availability and download are distinct. Making a file available for download is different from the End User actually downloading it.
15.2 Re-download. Re-download through the Services is available only where the applicable Creator Offering and Services support it. A completed download does not create a separate promise of indefinite re-download unless that promise was made.
15.3 File integrity. A file that is materially corrupt, incomplete, inaccessible, or unusable under the disclosed ordinary requirements may be treated as a delivery problem even if a download event was recorded.
15.4 License limits. Downloading a file does not expand the applicable license or transfer copyright ownership.
16. STREAMING, VIEW-ONLY, AND HOSTED ACCESS
16.1 Hosted access. For streamed, view-only, or hosted Digital Content, delivery may consist of granting the authorized technical route to the content for the applicable Access Period.
16.2 Interruptions. A temporary interruption is not automatically Non-Delivery or Material Misdescription, but the duration, cause, frequency, promised Access Period, and practical effect may be relevant to whether the governing terms were fulfilled.
16.3 No hidden compatibility condition. A material device, software, browser, external-account, accessibility, or network requirement that can reasonably prevent ordinary use should be disclosed where applicable before purchase.
17. COURSES, DIGITAL LIBRARIES, COMMUNITIES, AND MEMBERSHIP CONTENT
17.1 Component-level delivery. Access to one lesson, module, recording, library item, or community feature does not by itself establish delivery of every promised component.
17.2 What was promised controls. Promised modules, files, recordings, updates, future releases, library access, or community access are evaluated against the description and Transaction Terms that applied when the offering was obtained.
17.3 No implied future content. A Creator Offering does not include unspecified future modules, updates, or releases merely because the offering is a course, library, community, or membership.
17.4 Service components. Live, personalized, advisory, coaching, or other performed elements may constitute Creator Services and are governed accordingly.
18. MIXED AND BUNDLED CREATOR OFFERINGS
18.1 Separate components. Where one Creator Offering combines Digital Content with Creator Services or multiple Digital Content components, each promised component is evaluated according to its nature and applicable terms.
18.2 One component does not cure another. Delivery of one component does not automatically cure Non-Delivery, material delay, or material misdescription of another promised component.
18.3 Remedies. A Full Refund, Partial Refund, replacement, rescheduling, restoration, or another remedy is determined under the Refund and Cancellation Policy, Transaction Terms, and applicable law, not by this Section alone.
19. DELIVERY COMPLETION AND DELIVERY EVIDENCE
19.1 No universal completion event. The event that completes delivery depends on the Digital Content type and the promised delivery method. There is no single delivery-completion event for all Digital Content.
19.2 Relevant records. Where actually created, lawfully available, and retained, relevant records may include the transaction identifier, offering or content identifier, version information, entitlement status, release event, delivery timestamp, access grant, download event, viewing or streaming event, support communication, and restoration or removal event.
19.3 Evidence is contextual. A Delivery Record may be relevant but is not automatically conclusive. For example, a recorded login does not prove that every promised component was available, and a generated download link does not prove that a file was usable.
19.4 Accuracy. Creators and Users must not fabricate, backdate, materially alter, or misrepresent delivery or access records.
20. NON-DELIVERY
20.1 General. Non-Delivery occurs when promised Digital Content is not made available by the time or condition required by the applicable Transaction Terms or mandatory law.
20.2 Examples. Depending on the offering, Non-Delivery may include failure to grant purchased access, failure to release a due component, providing a nonfunctional delivery route with no reasonably available alternative, or failure to provide content that was an express material component of the purchase.
20.3 Not every access problem is Non-Delivery. An account-security restriction, temporary outage, ordinary disclosed expiration, buyer-side device issue, or future component that is not yet due is not automatically Non-Delivery.
20.4 Remedies. Remedies for Non-Delivery are determined by the Refund and Cancellation Policy, Transaction Terms, payment rules, and applicable law.
21. PARTIAL OR DELAYED DELIVERY
21.1 Partial delivery. Partial Delivery may occur when some, but not all, promised material components have been delivered.
21.2 Delayed delivery. Delayed Delivery may occur when Digital Content is made available after the promised time or condition.
21.3 Materiality. The importance of the missing or delayed component, the duration of delay, any agreed substitute, and the purpose of the purchase may be relevant to the appropriate remedy.
21.4 No universal grace period. This Policy does not create a universal grace period for late delivery.
22. CORRUPT, INCOMPLETE, OR UNUSABLE DELIVERY
22.1 Usability. Delivery is not necessarily adequate merely because bytes were transmitted or a link was generated. Digital Content may present a delivery problem if it is materially corrupt, incomplete, inaccessible, or unusable under the material technical requirements disclosed for the offering.
22.2 Troubleshooting. A Creator or Textority may reasonably request ordinary troubleshooting information, such as the affected content, date, error message, or relevant device or browser information, but a User is not required to disclose passwords or unnecessary sensitive payment credentials to prove a delivery issue.
22.3 Correction. Where appropriate and permitted by law, a corrected file, restored access, alternative delivery route, or replacement may resolve the issue if it provides materially what was promised.
23. INACCESSIBLE OR INTERRUPTED CONTENT
23.1 Temporary versus material unavailability. The duration, cause, recurrence, promised duration, and practical effect of an interruption determine whether it is a material access problem.
23.2 Buyer-controlled issues. A problem caused solely by unsupported buyer equipment, loss of internet service, forgotten credentials, or another buyer-controlled condition does not automatically create Textority or Creator liability, especially where the relevant requirement was properly disclosed.
23.3 Platform or Creator-controlled issues. A material failure within the control of Textority or the Creator is evaluated under the obligations that party actually undertook and applicable law.
24. MATERIAL MISDESCRIPTION OR MATERIAL DIFFERENCE
24.1 Description matters. Digital Content must materially match the description, components, format, access duration, and other material claims presented for the Creator Offering.
24.2 Minor differences. A minor non-material difference does not automatically constitute Material Misdescription.
24.3 Material difference. A significant difference in subject matter, quantity, format, promised component, access duration, technical compatibility, or other material characteristic may support a claim under the Refund and Cancellation Policy or applicable law.
25. ACCESS OR CONSUMPTION DOES NOT AUTOMATICALLY ELIMINATE RIGHTS
25.1 No universal final-sale rule. Opening, downloading, streaming, viewing, completing, or otherwise using Digital Content does not by itself make every sale final or eliminate every Refund, payment-dispute, statutory, or contractual right.
25.2 Usage may still matter. Access and usage may be relevant where a Creator Policy, Transaction Term, fraud review, Partial Refund calculation, or applicable law lawfully makes those facts relevant.
25.3 Mandatory rights. A mandatory right is not waived merely because Textority or a Creator has evidence that some content was accessed.
26. CONTENT UPDATES, REPLACEMENTS, AND VERSION CHANGES
26.1 Corrections and improvements. A Creator may correct errors or update Digital Content where doing so does not materially reduce the rights or value promised to existing buyers.
26.2 Material reduction. A Creator may not retroactively remove a promised material component, substantially shorten purchased access, or replace content with a materially inferior substitute unless permitted by the applicable Transaction Terms and law.
26.3 Future updates. There is no default promise of free future updates unless the Creator Offering stated that updates were included.
26.4 Different versions. Where multiple versions exist, records may identify which version was made available for a transaction when reasonably necessary to address delivery, support, Refund, or payment-dispute issues.
27. TECHNICAL REQUIREMENTS AND THIRD-PARTY DEPENDENCIES
27.1 Material requirements. Material technical requirements that can reasonably affect ordinary use should be disclosed before purchase where applicable.
27.2 No universal compatibility promise. Unless expressly stated for an offering, Textority does not promise compatibility with every device, operating system, browser, assistive technology, file reader, media player, or network condition.
27.3 Creator compatibility claims. A Creator is responsible for a specific accessibility, captioning, language, device, browser, software, file-format, or compatibility commitment the Creator makes, unless Textority expressly assumes it.
27.4 External services. If access materially depends on an external host, account, player, app, or link, that dependency should be disclosed where appropriate. The availability of a third-party service is subject to that service, but a third-party failure does not automatically excuse a contractual or statutory obligation owed by Textority or the Creator.
28. CREATOR DELETION, CHANNEL CLOSURE, OR ACCOUNT TERMINATION
28.1 Existing buyers. A Creator’s deletion of content, closure of a Channel, or termination of an account does not by itself erase an existing buyer’s unexpired purchased rights.
28.2 Creator obligations continue. A Creator remains responsible for commitments to existing buyers to the extent required by the governing terms and law.
28.3 Textority may preserve limited access where lawful. Subject to technical capability, legal rights, safety, and applicable terms, Textority may preserve or continue access as reasonably necessary to honor existing purchases.
28.4 Free or expired content. Textority may discontinue free, promotional, expired, or unpurchased content according to the governing terms, subject to mandatory law.
29. PURCHASED-ACCESS CONTINUITY AND RESTORATION
29.1 Continuity principle. If purchased Digital Content becomes unavailable before the end of a promised Access Period, the applicable remedy is determined by the Transaction Terms, Creator Policies, Textority policies, payment-provider or network requirements, and applicable law.
29.2 Possible corrective measures. Where lawful and technically available, corrective measures may include restoration, corrected delivery, an alternative access route, replacement of an equivalent promised component, continued access, or another agreed solution.
29.3 No forced materially different substitute. An End User is not required to accept a materially different substitute where the governing terms or applicable law provide a different remedy.
29.4 Refunds. Whether a Refund is required, available, partial, or discretionary is governed by the Refund and Cancellation Policy and mandatory law.
30. LEGAL, SAFETY, INTELLECTUAL-PROPERTY, AND TAKEDOWN OVERRIDE
30.1 Required or authorized removal. Textority may remove, disable, restrict, or decline to restore Digital Content where reasonably necessary for law, intellectual-property rights, privacy or publicity rights, child safety, non-consensual intimate imagery, fraud prevention, sanctions, security, a valid legal process, the Prohibited Products and Services Policy, or other grounds authorized by the Terms of Service.
30.2 Copyright process. Copyright removals and any applicable counter-notice or restoration process are governed by the Terms of Service, Textority’s applicable copyright procedures, and 17 U.S.C. § 512 where applicable.
30.3 No obligation to redeliver prohibited content. Purchased-access continuity does not require Textority to host, deliver, restore, or provide an alternative copy of content that Textority is legally required or contractually authorized to keep unavailable for a valid legal, rights, safety, or security reason.
30.4 Buyer remedies preserved. Removing content does not eliminate a buyer remedy that applicable law or the governing Transaction Terms require.
30.5 Creator responsibility. Removal does not release a Creator from buyer-facing or financial responsibility arising from the Creator’s conduct, content, or offering where the governing terms or law impose that responsibility.
31. REMOVAL BEFORE THE ACCESS PERIOD ENDS
31.1 Evaluation. If Digital Content is removed before a paid Access Period ends, Textority may evaluate the reason for removal, the remaining Access Period, whether lawful restoration or replacement is possible, and the remedies required by applicable terms and law.
31.2 Safety and legal removal. Where continued access would be unlawful, infringing, unsafe, or inconsistent with a valid order or legal process, Textority may keep the content unavailable even if the original Access Period has not ended.
31.3 No universal outcome. Removal may result in restoration, alternative performance, a Refund, a Partial Refund, no Refund, or another outcome depending on the facts, Transaction Terms, and mandatory law. This Policy does not create one universal remedy.
32. REFUNDS, CANCELLATIONS, AND PAYMENT DISPUTES
32.1 Refunds. Refund eligibility and amount are governed by the Refund and Cancellation Policy. Digital Content is not automatically non-refundable merely because it was made available or accessed.
32.2 Cancellation. Cancelling a Subscription generally stops future recurring charges according to the applicable Cancellation Effective Date. Cancellation does not automatically create a Refund for a prior charge.
32.3 Refund effect on access. A Full Refund or other reversal of the consideration for a particular Digital Content entitlement may result in termination of the corresponding access or license to the extent permitted by the governing terms and applicable law.
32.4 Payment disputes. Delivery and access records may be relevant to a Payment Dispute but are governed by the Chargeback and Payment Dispute Policy. An access event does not automatically prove that all promised content was delivered or that no dispute right exists.
33. SUBSCRIPTIONS, MEMBERSHIPS, TRIALS, AND RECURRING ACCESS
33.1 Recurring access. Where Digital Content access depends on an active Subscription, the Subscription and Auto-Renewal Terms govern enrollment, recurring authorization, renewal, cancellation, failed payments, and related notices.
33.2 After cancellation. Unless the applicable terms or law provide otherwise, a User who cancels after paying for a period may continue to receive the purchased access through the end of that paid period.
33.3 Earlier loss of access. Access may end earlier where a Refund is issued, a charge is reversed, fraud or account compromise requires protective action, content must be removed for legal or safety reasons, the Transaction Terms lawfully provide otherwise, or applicable law requires or permits earlier termination.
33.4 Failed payment. A failed recurring payment may result in restricted or expired paid access according to the applicable subscription terms and provider status.
34. ACCOUNT RESTRICTION, SUSPENSION, AND TERMINATION
34.1 Account action. Textority may restrict, suspend, or terminate accounts and Channels under the Terms of Service and applicable Additional Terms.
34.2 Purchased content. Account suspension or termination does not automatically determine the treatment of every purchased Digital Content entitlement. Textority may distinguish between account functionality, Channel access, free content, and unexpired purchased access where legally and technically appropriate.
34.3 Protective restrictions. Textority may restrict access where reasonably necessary for account security, fraud prevention, sanctions, legal process, safety, or abuse prevention.
34.4 No evasion of mandatory rights. Account action does not eliminate a non-waivable buyer remedy.
35. TEEN USERS AND GUARDIAN AUTHORIZATION
35.1 Teen access. Teen Users may access permitted Digital Content only under the age and guardian framework in the Terms of Service.
35.2 Purchases. A guardian is responsible for authorizing purchases or recurring enrollments connected to a Teen User to the extent described in the Terms of Service and permitted by law.
35.3 Content restrictions. Textority may restrict Teen Users from Digital Content, Channels, or Creator Offerings based on safety, law, category rules, or product requirements.
35.4 No per-access authorization created. This Policy does not require a separate guardian approval for each individual access event unless the Services or applicable law require one.
36. LICENSE LIMITS, CREDENTIAL SHARING, AND ABUSE
36.1 Personal access. Unless the applicable license states otherwise, purchased access is personal to the authorized End User and may not be resold, sublicensed, redistributed, or shared beyond the license granted for the Creator Offering.
36.2 Credentials. Users may not share account credentials to circumvent access limits, payment requirements, subscription terms, or lawful technical protections.
36.3 Circumvention. Users may not bypass access controls, copy protections, entitlement restrictions, or other safeguards in violation of the governing terms or law.
36.4 Good-faith rights. A good-faith report of Non-Delivery, inaccessible content, a Refund request, a payment dispute, or a legal complaint is not abuse merely because the claim is later denied.
37. RECORDS, PRIVACY, AND SECURITY
37.1 Records. Textority and Creators may maintain records reasonably necessary to document transaction terms, delivery, access, support, refunds, disputes, fraud prevention, safety, and legal compliance, subject to the applicable privacy documents and law.
37.2 No universal record set. This Policy does not represent that Textority creates, collects, or retains every possible delivery or access record for every Creator Offering.
37.3 Data minimization. Delivery and access investigations should use information reasonably relevant to the issue and should not require unnecessary sensitive credentials.
37.4 Retention. This Policy does not establish a universal numerical retention period. Retention is governed by applicable privacy terms, operational requirements, legal obligations, and legitimate dispute or safety needs.
38. UNITED STATES AND COLOMBIA CONSUMER RULES
38.1 United States. U.S. consumer-protection law applies to online offers and advertising. Material claims and qualifications concerning Digital Content, including delivery, access duration, compatibility, recurring access, and material limitations, must not be deceptive or misleading. This Policy does not create a universal federal delivery deadline for all Digital Content and does not limit stronger state-law rights.
38.2 Colombia pre-purchase delivery disclosure. For a Colombian consumer transaction subject to Article 50 of Law 1480 of 2011, as amended, the applicable delivery period must be informed before completion of the electronic-commerce transaction.
38.3 Colombia delivery deadline. Where Article 50 applies and no delivery period was agreed, the statutory default requires delivery no later than thirty (30) calendar days beginning the day after the consumer communicated the order. Where an agreed or statutory delivery period is exceeded, or the purchased product is unavailable, the consumer may have the statutory right to terminate the contract and obtain return of amounts paid, subject to the requirements of applicable law.
38.4 Colombia refund timing for Article 50 remedy. Where the Article 50 late-delivery or unavailability remedy applies, the statutory return of amounts paid must be made within the period required by then-current law. As of the Last Updated date of this Policy, the amended statute provides a maximum period of fifteen (15) calendar days for that return.
38.5 Colombia right of withdrawal. The right of withdrawal under Article 47 of Law 1480, including its five-business-day period and statutory exceptions, is governed by the Refund and Cancellation Policy and applicable law. Immediate delivery or access does not create a broader waiver than Colombian law permits.
38.6 Colombia complaints and records. Where Colombian e-commerce rules require complaint channels, transaction records, order information, or other consumer-facing mechanisms, the responsible party must provide them as required by law. Nothing in this Policy reduces those obligations.
39. CHANGES AND DISPUTE RESOLUTION
39.1 Prospective changes. Textority may update this Policy prospectively in accordance with the Terms of Service. A later policy update does not by itself retroactively reduce the delivery, access, or license rights attached to a completed purchase.
39.2 Mandatory acceptance. Textority will request affirmative acceptance of a material change where required by applicable law or the Terms of Service.
39.3 Dispute resolution. The dispute-resolution provisions in the Terms of Service govern legal disputes between Textority and persons bound by this Policy. This Policy does not create a separate arbitration agreement or limitations period.
