TEXTORITY CREATOR TERMS
Last Updated: September 30, 2026
These Creator Terms apply to textority.com, text.me, text.to, lets.talk, the Textority web platform, and related websites and online services made available by Textority Inc. through which a Creator operates a Channel, communicates with an audience, makes Creator Content available, offers a Creator Offering, uses Creator commerce features, or uses Creator-facing artificial intelligence or automation features.
IMPORTANT NOTICES FOR CREATORS
These are Additional Terms. These Creator Terms supplement the Textority Terms of Service and do not replace them. The Terms of Service continue to apply to you. Capitalized terms not defined here have the meanings given in the Terms of Service.
You are responsible for your Creator business. You are responsible for your Creator Content and Creator Offerings, including their legality, accuracy, claims, licensing, quality, delivery, performance, support, professional conduct, privacy practices, communications, and compliance with applicable law.
Payment and seller roles are transaction-specific. Textority may provide or administer checkout, payment, refund, dispute, payout, or other commerce functionality, but these Creator Terms do not designate Textority as merchant of record or contracting seller for every Creator Offering transaction. The applicable Transaction Terms, Payment Terms, checkout, order confirmation, receipt, and payment-provider configuration determine the material commercial roles for a paid transaction.
Creator selling is conditional. Selling, payment acceptance, and payouts are available only where Textority and the applicable payment providers support the Creator, country, currency, category, transaction type, and payment configuration. Verification or prior availability does not guarantee continued eligibility.
Creator roles are adult-only. A Creator, Channel owner, seller, payout recipient, or person holding an administrative, payment, payout, export, moderation, or AI-configuration role must be at least 18 years old, or the age of majority where that person resides if higher.
Dispute resolution is governed by the Terms of Service. Section 29 of the Terms of Service contains the agreement to arbitrate, class action waiver, jury trial waiver, opt-out procedure, governing law, and related dispute terms. These Creator Terms do not create a separate dispute-resolution system.
1. AGREEMENT, SCOPE, AND ACCEPTANCE
1.1 Parties. These Creator Terms are a binding agreement between you and Textority Inc., a Delaware corporation (“Textority,” “we,” “us,” or “our”).
1.2 Creator. “Creator” means the individual or legal entity identified as responsible for a Channel or Creator Offering. Where a legal entity operates a Channel, that entity is the Creator for Creator-level commercial obligations.
1.3 Creator Team Member. “Creator Team Member” means an individual invited or authorized by a Creator to access or administer a Channel within assigned permissions. A Creator Team Member does not become the Creator, Channel owner, seller, supplier, or payout recipient solely because that person accepts a team invitation or administrative role.
1.4 Who these Creator Terms cover. These Creator Terms apply to a person or entity that creates, owns, controls, or operates a Channel; activates Creator features; offers free or paid Creator Offerings; enables selling; requests or receives payouts; configures Creator-facing Textority AI or automation; manages a Creator community; or acts as an authorized Creator Team Member.
1.5 Acceptance. You accept these Creator Terms when you take an affirmative action that Textority presents as acceptance, including activating Creator status, completing Creator onboarding, enabling selling or payouts, accepting an administrative role that requires these Creator Terms, or clicking or tapping an acceptance control. Passive browsing alone is not acceptance.
1.6 Entity acceptance. If an individual accepts these Creator Terms for a company or other entity, the individual represents that the individual has authority to bind that entity. The entity is responsible for its Creator-level commercial obligations. The individual remains responsible for that individual’s own credentials, security, permissions, fraud, intentional misconduct, unlawful conduct, infringement, unauthorized access, and other obligations expressly applicable to the individual’s conduct. The individual does not become personally responsible for the entity’s ordinary commercial obligations solely because the individual accepted for the entity.
1.7 Records. Textority may retain records reasonably necessary to evidence acceptance, authority, assigned role, verification, and permissions, including the version accepted, associated account, acceptance action, and date and time.
1.8 If you do not agree. If you do not agree to these Creator Terms, do not operate a Channel or use Creator features that require acceptance of them.
2. RELATIONSHIP TO THE TERMS OF SERVICE AND OTHER TERMS
2.1 Additional Terms. These Creator Terms are Additional Terms under Section 30 of the Terms of Service and apply to their specific Creator-related subject matter.
2.2 Terms of Service continue to apply. The Terms of Service continue to apply in full. These Creator Terms supplement the Terms of Service rather than restating every rule that applies to Creators.
2.3 Defined terms. Capitalized terms not separately defined here have the meanings given in the Terms of Service, including Channel, Creator Content, Creator Offering, Creator Policies, Creator Services, Digital Content, End User, Teen User, Textority AI, Transaction Terms, User, and User Content.
2.4 Other Additional Terms. Depending on the feature or transaction, additional documents may apply, including the Prohibited Products and Services Policy, Payment Terms, Creator Payout Terms, Refund and Cancellation Policy, Subscription and Auto-Renewal Terms, Chargeback and Payment Dispute Policy, Digital Content Delivery and Access Policy, marketplace or seller disclosures, privacy terms, AI terms, messaging terms, Regional Terms, and provider terms separately presented to you.
2.5 Order of precedence. Section 30.5 of the Terms of Service governs conflicts among applicable documents. These Creator Terms control over the Terms of Service only for their specific Creator-related subject matter. Mandatory law controls where it cannot be varied by agreement.
2.6 No retroactive application of later terms. A later-published Additional Term does not retroactively change a completed transaction unless applicable law permits and the governing terms provide for that change.
2.7 Disputes. Section 29 of the Terms of Service governs disputes between you and Textority. These Creator Terms do not create a separate arbitration agreement, forum, class waiver, jury waiver, limitations period, or governing-law rule.
3. CREATOR ELIGIBILITY, VERIFICATION, AND ONBOARDING
3.1 Adult-only Creator roles. You must be at least 18 years old, or the age of majority where you reside if higher, to own or control a Channel, sell a Creator Offering, receive payouts, or hold an administrative, payment, payout, export, moderation, or AI-configuration role.
3.2 Capacity and authority. You must have legal capacity to enter into these Creator Terms and, if acting for an entity, authority to bind that entity.
3.3 Supported countries and categories. Creator selling, payment methods, currencies, and payouts are limited to countries, categories, and configurations Textority and its payment providers actually support. Availability may differ by Creator, country, currency, transaction type, payment method, provider, and risk status.
3.4 Accurate information. You must provide accurate, current, and complete information reasonably requested for your account, Channel, business, beneficial ownership, control persons, tax status, payment or payout account, professional status, Creator Offerings, and verification, and must keep that information current.
3.5 Verification. Textority or a payment provider may require identity, business, beneficial-ownership, control-person, bank-account, tax, sanctions, professional-license, category, fraud, or other verification reasonably related to the Services you request. Selling, payment acceptance, features, or payouts may be limited while verification is incomplete or under review.
3.6 Provider terms. A payment provider may require you to enter into separate terms directly with that provider. You must comply with provider terms that are validly presented and applicable to you. Provider acceptance is not guaranteed and may be limited, suspended, or withdrawn under the provider’s rules.
3.7 Verification is limited. A verification check is limited to the specific information reviewed at the time. Verification is not Textority endorsement or certification and does not guarantee competence, legal compliance, continued licensure, financial condition, or suitability for any End User.
3.8 Sanctions and legal eligibility. You may not use Creator features if doing so would violate applicable sanctions, export controls, court orders, or other legally binding restrictions.
4. CHANNELS, USERNAMES, OWNERSHIP, AND CONTROL
4.1 Responsible Creator. Each Channel must identify the individual or legal entity responsible for it. That party is the Creator for Creator-level obligations under these Creator Terms.
4.2 Usernames and Textority URLs. Usernames, handles, Channel addresses, and personalized Textority URLs are governed by Section 6 of the Terms of Service. They are limited, revocable, non-exclusive, non-transferable permissions to use identifiers within the Textority ecosystem and are not property.
4.3 No trafficking or misleading control. You may not sell, auction, rent, license, or transfer a Textority identifier except through a process Textority expressly permits, or register identifiers primarily to block another person or profit from resale. You may not misrepresent who owns, operates, controls, or is responsible for a Channel.
4.4 Account security. You are responsible for safeguarding Creator account credentials, assigning appropriate permissions, using available security features responsibly, and promptly reporting suspected unauthorized access.
4.5 Transfers and ownership changes. A Channel or entity account may be transferred only as Textority permits and subject to verification of the transferee, acceptance of applicable terms, payment and payout requirements, legal restrictions, and treatment of existing buyer obligations.
4.6 Existing obligations continue. A transfer, closure, rebranding, suspension, or termination does not by itself eliminate obligations relating to existing buyers, purchased access, refunds, disputes, chargebacks, taxes, records, or other accrued matters.
5. CREATOR TEAM MEMBERS AND PERMISSIONS
5.1 Least privilege. A Creator must assign Creator Team Members only the permissions reasonably needed for their roles and must separately consider permissions involving conversations, moderation, AI configuration, data export, payments, payouts, and account ownership.
5.2 Creator responsibility. The Creator is responsible for provisioning and revoking access and for authorized Creator Team Member conduct within assigned roles or through credentials, permissions, integrations, or systems the Creator provided, authorized, or unreasonably failed to revoke.
5.3 Team Member responsibility. A Creator Team Member is personally responsible for that individual’s own fraud, intentional misconduct, unlawful conduct, infringement, credential misuse, unauthorized access, misuse of data, and knowing misuse of the Services.
5.4 No automatic commercial liability. A Creator Team Member does not become personally responsible for the Creator’s plan fees, transaction fees, refunds, chargebacks, negative balances, taxes, payouts, fulfillment obligations, Creator Policies, professional obligations, or indemnification solely because of assigned access or acceptance of these Creator Terms.
5.5 Access changes. The Creator must promptly remove or reduce permissions when a Creator Team Member no longer needs them or when continued access creates a material security, privacy, legal, or business risk.
6. CREATOR OFFERINGS AND CATEGORY ELIGIBILITY
6.1 Supported launch formats. Subject to Textority’s actual enabled features, Creator Offerings may include Digital Content, access, memberships, subscriptions, courses, bookings, and Creator Services that Textority permits.
6.2 Physical goods. Physical goods and shipping transactions are not supported at launch unless Textority later expressly enables them under updated terms and applicable product, payment, tax, consumer, and operational requirements.
6.3 Prohibited and restricted categories. You must comply with the Prohibited Products and Services Policy and any category-specific rules that apply to you. A category may be prohibited or restricted even if it is lawful in a particular jurisdiction.
6.4 Lawful and supportable offerings. You may not offer, advertise, fund, sell, book, deliver, or facilitate through the Services any offering that is unlawful, infringing, deceptive, unsafe, or unsupported by Textority or an applicable payment provider.
6.5 Category approval. Where a category requires prior approval, you may not offer or process it until the required approval has been granted. Approval may be conditioned, limited, suspended, or withdrawn based on law, licensing, provider requirements, safety, fraud, chargebacks, consumer risk, or operational readiness.
6.6 No circumvention by labeling. You may not disguise a prohibited or restricted activity as coaching, education, consulting, membership, digital content, community access, a donation, or another permitted category.
6.7 Future features. A reference to a possible category or feature does not mean it is currently available. A feature is available only if Textority actually enables it for the applicable Creator and jurisdiction.
7. CREATOR STATUS, SELLER ROLES, AND TRANSACTION ARCHITECTURE
7.1 Creator as substantive provider. Unless Textority expressly identifies itself as the substantive provider of a particular offering, the Creator creates or supplies the Creator Content and supplies, performs, delivers, supports, and stands behind the Creator Offering.
7.2 Transaction-specific seller and payment roles. For a paid Creator Offering, the applicable Transaction Terms, checkout, order confirmation, receipt, Payment Terms, and provider configuration determine material transaction roles, which may include the contracting seller, merchant of record, payment recipient, payment provider, and supplier. These Creator Terms do not assign one merchant-of-record or contracting-seller model to every transaction.
7.3 When the Creator is identified as seller. If applicable Transaction Terms identify the Creator as the contracting seller, merchant, provider, or another legally responsible seller role, the Creator is responsible for the obligations attached to that role under the applicable transaction structure and law, except to the extent Textority expressly assumes a specific obligation.
7.4 When Textority is identified as seller or merchant of record. If applicable Transaction Terms identify Textority as contracting seller or merchant of record for a transaction, the Creator remains responsible for its own Creator Content, description, claims, intellectual-property rights, fulfillment, delivery, performance, support, professional conduct, and other Creator obligations allocated by these Creator Terms and the applicable transaction documents.
7.5 External classifications. Contractual labels do not override a statutory, tax, payment-network, acquiring-bank, or provider classification whose elements are actually met. You must provide information reasonably necessary for Textority to apply applicable transaction and regulatory requirements.
7.6 Payment-provider labels do not control by themselves. A technical account label, charge type, statement descriptor, provider dashboard field, or funds-flow step does not by itself determine the contractual or statutory role of Textority or the Creator.
7.7 Professional relationships. Where applicable law recognizes a professional relationship directly between a licensed Creator and an End User, that professional relationship is between the Creator and End User unless expressly stated otherwise. Textority is not a party to it merely because the Services facilitate communication, scheduling, content, or payment functionality.
7.8 No endorsement or employment. Textority does not employ, supervise, certify, or endorse a Creator merely because the Creator uses the Services, passes a verification check, or receives a badge or search placement.
8. LISTINGS, MARKETING, AND BUYER DISCLOSURES
8.1 Accurate material information. You must provide accurate, complete, current, and non-misleading information reasonably required to describe a Creator Offering and your role, including your identity or trading name, contact or support method, what is included, material exclusions, price where applicable, currency, delivery or performance method, delivery timing, access duration, material limitations, recurring terms, cancellation terms, refund terms, license terms, eligibility requirements, and professional credentials where material.
8.2 Transaction disclosures. You must provide the information Textority reasonably requires to make transaction-specific disclosures. You may not contradict a checkout, order confirmation, receipt, seller disclosure, or other Transaction Term that accurately describes the applicable transaction architecture.
8.3 Truthful advertising. Creator listings, advertisements, earnings claims, health claims, financial claims, professional claims, comparative claims, testimonials, endorsements, before-and-after claims, scarcity claims, and other material representations must be truthful, non-misleading, and adequately substantiated where law requires substantiation.
8.4 Reviews and testimonials. You may not create, buy, sell, procure, disseminate, or knowingly use fake or false reviews or testimonials; condition an incentive on a particular positive or negative sentiment; use an insider or materially connected review without a required clear disclosure; falsely present a controlled review source as independent; unlawfully suppress negative reviews; misrepresent that displayed reviews represent all or most submitted reviews where sentiment-based suppression occurred; or buy or sell fake indicators of social influence.
8.5 Honest review requests. Nothing in Section 8.4 prohibits requesting an honest review, offering a lawful incentive that is not conditioned on sentiment and is properly disclosed, or removing spam, fraud, harassment, unlawful content, personal information, or irrelevant material under neutral rules.
8.6 No manipulative sales practices. You may not use false urgency, fabricated scarcity, hidden recurring terms, deceptive countdowns, misleading defaults, coercive or exploitative sales tactics, or other practices that materially impair an End User’s ability to make an informed choice.
8.7 No false affiliation. You may not state or imply that Textority, a payment provider, a regulator, or another third party endorses, certifies, sponsors, guarantees, or partners with you unless that statement is accurate and authorized.
8.8 Colombia transactions. Where Colombian consumer law applies to you as a producer, provider, supplier, or seller, you must provide the identity, contact, offering, pricing, delivery or performance, complaint, withdrawal or reversal, and other information that applicable law requires, and maintain evidence required for the electronic transaction. You may rely on Textority to perform a specific disclosure or transaction function only where Textority expressly undertakes that function for the applicable transaction.
9. CREATOR POLICIES
9.1 Required Creator Policies. Where applicable to a Creator Offering, you must provide and keep current Creator Policies addressing delivery or performance, access duration, license terms, buyer support, refunds, cancellations or rescheduling, and recurring terms.
9.2 Presentation and incorporation. Creator Policies become binding for a transaction only to the extent they are properly presented, incorporated, or accepted before the purchase or enrollment under the applicable Transaction Terms and law.
9.3 Mandatory rights. A Creator Policy may not waive, restrict, or disclaim a non-waivable consumer right, payment right, statutory warranty, or other mandatory protection.
9.4 Consistency. A Creator Policy may not contradict higher-priority Textority terms, misstate the transaction parties or roles, promise a capability Textority does not support, or shift to Textority an obligation Textority has not expressly assumed.
9.5 More generous terms. You may offer terms more favorable to an End User than Textority’s minimum framework where lawful. If those terms are presented as part of the transaction, you must honor them.
9.6 No retroactive reduction. You may change Creator Policies prospectively but may not retroactively reduce rights, shorten purchased access, remove promised components, or alter material terms for a completed purchase where the governing terms or law prohibit that change.
9.7 Platform defaults and templates. Textority may provide templates, minimum requirements, or default disclosures. Use of a Textority template does not transfer responsibility for your Creator Policy or underlying Creator Offering to Textority.
10. FULFILLMENT, DELIVERY, ACCESS, AND CONTINUITY
10.1 Fulfillment. You must supply, perform, and support each Creator Offering according to the material terms presented for that offering.
10.2 Digital Content. You must provide Digital Content according to the disclosed delivery method, timing, components, access duration, and material technical requirements. The Digital Content Delivery and Access Policy governs detailed delivery and access mechanics where applicable.
10.3 Creator Services. You must perform Creator Services according to the material scope, timing, scheduling, rescheduling, participation, and performance terms presented for the service.
10.4 Purchased access. You may not intentionally strand existing buyers by closing a Channel, deleting content, transferring a Channel, or terminating your account to avoid a purchased access or fulfillment obligation.
10.5 Legal and safety override. Textority is not required to host, deliver, restore, or preserve content that is unlawful, infringing, prohibited, subject to a valid removal request or legal order, or reasonably restricted for safety, security, or legal compliance. Where continued access cannot lawfully or safely be provided, the applicable remedy is determined by the governing Transaction Terms, Textority policies, payment rules, and law.
10.6 Accessibility and compatibility claims. If you make a specific accessibility, device, browser, file-format, captioning, language, or compatibility commitment for a Creator Offering, you are responsible for the accuracy and fulfillment of that commitment unless Textority expressly assumes it.
11. PAYMENTS, FEES, BALANCES, AND PAYOUTS
11.1 Payment Terms govern. Payment authorization, transaction accounting, payment methods, fees, taxes, refunds, reversals, disputes, and related payment mechanics are governed by the applicable Payment Terms and Transaction Terms.
11.2 Provider configuration may vary. Payment flows may differ by country, payment method, Creator, transaction type, and provider configuration. You must complete any provider onboarding and comply with applicable provider requirements.
11.3 Fees. Textority may charge plan fees, platform fees, transaction fees, payout fees, or other charges only as disclosed before they apply. Current pricing and fee information may be stated in the Services, on a Pricing Page, in an order flow, or in applicable Additional Terms.
11.4 Deductions and adjustments. Amounts otherwise payable to a Creator may be adjusted only as authorized by applicable terms or law, including for disclosed fees, taxes or withholding, refunds, reversals, chargebacks, payment disputes, currency conversion, payout costs, reserves, holds, negative balances, fraud, provider adjustments, or other properly disclosed obligations.
11.5 Payout eligibility. A displayed Creator balance is not necessarily immediately payable. Payout eligibility may depend on settlement, verification, supported country and currency, provider approval, tax documentation, minimum thresholds, reserves, holds, disputes, refunds, chargebacks, legal restrictions, and other conditions stated in the Creator Payout Terms.
11.6 No guaranteed payout schedule. Unless a binding term expressly states a payout schedule for your account, Textority does not guarantee a particular payout day or bank settlement time. A payment provider or financial institution may delay, reject, return, or restrict a payout.
11.7 Reserves and holds. Where permitted by the applicable terms and law, Textority or a payment provider may apply a reasonable reserve or hold to address settlement, refund, chargeback, fraud, compliance, verification, provider, or legal risk. The Creator Payout Terms govern the applicable mechanics.
11.8 Negative balances and recovery. If refunds, reversals, disputes, chargebacks, taxes, fees, or other valid adjustments exceed amounts otherwise payable to you, you may owe a negative balance to the party entitled to recover it under the applicable payment architecture and terms.
11.9 No bank or stored-value relationship. A balance shown in the Services does not by itself create a deposit account, stored-value account, trust, escrow, custody, fiduciary, or banking relationship.
12. REFUNDS, CANCELLATIONS, REVERSALS, AND PAYMENT DISPUTES
12.1 Applicable rules. Refund and cancellation rights depend on the Refund and Cancellation Policy, applicable Creator Policies, Transaction Terms, payment-provider or network rules, and mandatory law.
12.2 Creator cooperation. You must respond reasonably and promptly to delivery, performance, refund, cancellation, fraud, and payment-dispute inquiries relating to your Creator Offerings and provide evidence reasonably requested to evaluate or respond to the matter.
12.3 Financial responsibility. You are financially responsible for refunds, reversals, chargebacks, dispute fees, and related transaction losses to the extent the applicable Payment Terms, Creator Payout Terms, Transaction Terms, or law allocate those amounts to you. These Creator Terms do not impose a payment liability that conflicts with the actual transaction architecture.
12.4 Textority action. Textority may issue or administer a refund, cancellation, reversal, or dispute response where Textority is required or authorized to do so by applicable law, provider or network rules, Transaction Terms, Creator Policies, or applicable Textority policies.
12.5 No obstruction. You may not interfere with an End User’s non-waivable right to contact a payment provider, card issuer, regulator, court, or other legally available complaint or dispute mechanism.
12.6 Evidence. You must not fabricate, alter, or misrepresent delivery records, communications, transaction records, or other evidence submitted in connection with a refund, chargeback, dispute, complaint, investigation, or legal process.
13. SUBSCRIPTIONS, MEMBERSHIPS, AND TRIALS
13.1 Recurring terms. Before a recurring Creator Offering is enrolled, you must provide accurate material information reasonably required for the enrollment flow, including the recurring amount or method for determining it, billing frequency, renewal timing, trial or promotional terms, cancellation terms, and material access conditions.
13.2 No hidden renewal. You may not describe a recurring Creator Offering in a way that obscures automatic renewal, the recurring price, the billing frequency, the end of a trial or promotion, or how to stop future charges.
13.3 Changes. A change to the price, billing frequency, access, or other material recurring term must be handled prospectively under the applicable Subscription and Auto-Renewal Terms, Transaction Terms, and law. You may not use a policy edit to retroactively authorize a charge.
13.4 Cancellation. You must cooperate with the cancellation process Textority makes available and may not impose a cancellation obstacle that Textority could not lawfully impose for the applicable transaction.
13.5 Trial conversion. A free or reduced-price trial may convert to a paid subscription only where the conversion, timing, and resulting charge are properly disclosed and authorized.
14. TAXES AND REQUIRED BUSINESS DOCUMENTATION
14.1 Your taxes. You are responsible for taxes imposed directly on you or your Creator business, including income, payroll, business, professional, and similar taxes, unless applicable law expressly places responsibility elsewhere.
14.2 Transaction taxes. Sales, use, value-added, consumption, withholding, digital-services, or similar transaction taxes are handled according to the applicable transaction structure and law. Textority or a payment provider may calculate, collect, report, remit, or withhold amounts where required or where the applicable terms provide for that service.
14.3 Tax information. You must provide accurate tax documentation reasonably required for reporting, withholding, payment processing, or payout eligibility and promptly update it when materially changed.
14.4 Invoices and commercial documents. Where law requires you to issue an invoice, receipt, tax document, consumer disclosure, or other commercial record in your role for the applicable transaction, you are responsible for doing so unless Textority expressly undertakes that obligation.
14.5 No tax advice. Textority does not provide tax advice. You are responsible for obtaining professional advice appropriate to your circumstances.
15. CREATOR CONTENT, OWNERSHIP, AND LICENSES
15.1 Your ownership. As between you and Textority, you retain ownership of Creator Content, subject to third-party rights and the licenses you grant under the Terms of Service and these Creator Terms.
15.2 Required rights. You must own or have all rights, permissions, licenses, releases, and consents necessary to upload, host, reproduce, display, transmit, advertise, sell, sublicense, perform, and deliver Creator Content and Creator Offerings through the Services.
15.3 Operating license. Section 17 of the Terms of Service governs the limited license you grant Textority to host, store, reproduce, process, transmit, display, format, adapt for technical purposes, and otherwise use Creator Content as reasonably necessary for the stated service, transaction, safety, legal, and operational purposes.
15.4 Delivery and End User access. You authorize Textority to make Creator Content available to End Users to the extent necessary to deliver or provide access to the applicable Creator Offering and to honor purchased access, subject to applicable license terms and Transaction Terms.
15.5 End User license terms. If you want a Creator Offering to carry specific End User license restrictions, you must clearly provide those restrictions for presentation before purchase or access where required. A license may not contradict mandatory law or a higher-priority Textority term.
15.6 Names, likenesses, music, and third-party material. You are responsible for obtaining rights needed for names, images, likenesses, voices, music, trademarks, copyrighted works, confidential material, personal information, and other third-party material included in Creator Content.
15.7 Public content. Content you intentionally make public may be visible, linked, indexed, shared, or cached according to the nature of the Services and applicable settings.
16. TEXTORITY AI AND AUTOMATION
16.1 Creator responsibility for configuration. If you configure Textority AI, prompts, knowledge sources, automations, response rules, permissions, or actions for a Channel, you are responsible for those configurations and for ensuring that your use complies with law, the Terms of Service, these Creator Terms, and applicable professional obligations.
16.2 Review output. AI and automated output may be inaccurate, incomplete, outdated, biased, offensive, or unsuitable. You are responsible for appropriate review before relying on, publishing, sending, or acting on output in connection with your Creator business.
16.3 No false human identity. You may not configure AI or automation to impersonate a specific real person, falsely claim to be human, falsely claim to hold a professional credential, or intentionally defeat an AI or automation disclosure the Services present where doing so would mislead a User or violate law.
16.4 Authority and sensitive actions. You may not use AI or automation to bypass Textority restrictions involving payments, account ownership, identity, safety, professional services, access control, Teen Users, or other sensitive functions. An AI or automated statement does not create authority for a transaction or professional action that the Services do not support.
16.5 Professional use. If you are a regulated professional, you are responsible for determining whether and how AI may be used consistently with your licensing, confidentiality, supervision, competence, recordkeeping, disclosure, and professional-conduct duties.
16.6 Data practices. Personal information and Creator Content processed through Textority AI are handled under the applicable Privacy Policy, AI notices, and Additional Terms. These Creator Terms do not state that content is or is not used for model training unless an applicable Textority notice or agreement expressly makes that commitment.
16.7 No emergency reliance. Textority AI and Creator-configured automation are not emergency services and must not be represented as a substitute for emergency response, crisis intervention, or regulated professional care that Textority does not support.
17. PRIVACY, AUDIENCE DATA, AND SECURITY
17.1 Independent Creator obligations. To the extent you determine the purposes or means for using personal information obtained through the Services, you are responsible for your own applicable privacy and data-protection duties, including notices, consents or other lawful bases, purpose limitation, data minimization, security, retention, deletion, data-subject rights, and restrictions on sharing.
17.2 Textority role. Textority’s privacy role depends on the processing activity, applicable law, and any applicable Data Processing Addendum. These Creator Terms do not classify Textority as processor, service provider, controller, or business for every processing activity.
17.3 Use limitation. Access to End User information through Textority authorizes use only for lawful purposes connected to the Channel, Creator Offering, audience relationship, or another purpose properly disclosed and permitted. You may not sell, disclose, enrich, or use End User information for unrelated purposes without the rights and legal basis required to do so.
17.4 Sensitive information. You may not solicit or process sensitive personal information through the Services unless the feature, category, and use are supported and you have all permissions and safeguards required by law.
17.5 Security. You must use reasonable safeguards appropriate to the information you control, protect exported data and credentials, limit team access, and promptly act on suspected unauthorized access. You may not represent that Textority communications are end-to-end encrypted or make another security claim about Textority that Textority has not verified and authorized.
17.6 Colombia personal data. Where Colombian data-protection law applies to your processing, you must determine and comply with the duties applicable to you as a Responsable del Tratamiento, Encargado del Tratamiento, or other applicable role, including authorization, notice, purpose limitation, security, confidentiality, and data-subject rights where required. An applicable Data Processing Addendum may further allocate processing duties.
18. MESSAGING, AUTOMATION, AND COMMUNICATIONS
18.1 Consent and compliance. If you send or cause messages, emails, automated communications, or marketing communications through the Services, you are responsible for obtaining any consent required by law, honoring opt-outs, using accurate sender information, and complying with applicable anti-spam, telemarketing, privacy, advertising, and consumer-protection rules.
18.2 No scraped or unlawfully obtained lists. You may not use the Services to contact persons through unlawfully obtained, purchased, scraped, or harvested contact information where the communication is not legally permitted.
18.3 Accurate sender identity. You may not falsify or conceal sender identity, routing information, or the commercial nature of a communication where disclosure is required.
18.4 Opt-outs. You must honor valid opt-out, unsubscribe, revocation, or do-not-contact requests as required by applicable law and the communication channel used.
18.5 Provider rules. Third-party communication providers and networks may impose additional rules, volume limits, consent standards, filtering, or content restrictions. You must comply with applicable provider rules presented to you.
18.6 No delivery guarantee. Textority does not guarantee delivery, receipt, timing, placement, or response for communications transmitted through third-party networks.
19. PROFESSIONAL, REGULATED, AND HIGHER-RISK SERVICES
19.1 Textority is not the professional. Textority is not a law firm, medical provider, mental-health provider, financial institution, investment adviser, broker, insurer, accounting firm, emergency service, or other licensed professional merely because a Creator uses the Services.
19.2 Category restrictions. Professional, regulated, and higher-risk services are subject to Section 13 of the Terms of Service and the Prohibited Products and Services Policy. A category may require prior approval or may be prohibited at launch.
19.3 Creator qualifications. If a professional service is permitted, you are solely responsible for determining and maintaining every license, registration, supervision arrangement, jurisdictional authorization, engagement term, conflict process, disclosure, record, insurance policy, and professional standard required for your service.
19.4 Confidentiality and privilege. Textority does not determine whether a communication is legally privileged or subject to professional confidentiality. You are responsible for determining whether the Services, settings, team access, integrations, AI features, retention practices, and communication methods are appropriate for your professional duties.
19.5 No client funds or regulated financial custody. You may not use the Services to hold client trust funds, escrow funds, investment assets, deposits, or other fiduciary or custodial funds unless Textority expressly enables a legally approved product for that purpose.
19.6 No emergency service. You must not represent Textority or Textority AI as an emergency, crisis, medical, legal, or financial response service.
20. TEEN-ELIGIBLE CHANNELS AND MINORS
20.1 Adult-only Creator roles. Teen Users may not own or control a Channel, sell Creator Offerings, receive payouts, or hold administrative, payment, payout, export, moderation, or AI-configuration roles.
20.2 No targeting children under 13. You must not knowingly direct an interactive Channel or Creator Offering to children under 13, encourage a child under 13 to create an account, instruct a User to falsify age, circumvent age or guardian controls, or knowingly continue an interactive relationship after learning that the User is under 13.
20.3 Teen-Eligible Channels. If Textority permits a Channel or Creator Offering to be available to Teen Users, you must comply with the guardian framework and any age, category, content, communication, AI, purchase, and safety restrictions Textority applies.
20.4 Prohibited conduct involving minors. You must not groom, sexually exploit, traffic, solicit sexual content from, request intimate imagery from, or engage in predatory conduct toward a minor; solicit secret communications intended to evade lawful guardian safeguards; request unnecessary sensitive information; use manipulative or emotionally exploitative sales techniques; or retaliate against a person who raises a safety concern.
20.5 Age uncertainty. If you know or reasonably suspect that an account is being used by a child under 13 in violation of the Terms of Service, stop the interactive engagement and report the matter through the reporting route Textority makes available. Do not investigate illegal content yourself or request additional illegal material.
20.6 Purchases by Teen Users. Purchases connected to a Teen User are subject to the guardian authorization framework in Section 4 of the Terms of Service and applicable Transaction Terms.
21. COMMUNITIES, GROUPS, AND PARTICIPANT CONTENT
21.1 Creator moderation. If you operate a group, community, cohort, or other multi-participant space, you are responsible for reasonable rules and moderation within the controls Textority makes available and for acting on reports or escalating matters that require Textority action.
21.2 Participant content. Participant content remains User Content under the Terms of Service. You do not acquire ownership of it merely because it appears in your Channel or community.
21.3 Access terms. If community or group access is sold or included in a Creator Offering, you must accurately disclose and honor the applicable access duration and material participation terms, subject to legal and safety removals.
21.4 No retaliation. You may not retaliate against a User for making a good-faith report, exercising a consumer right, or reporting suspected unlawful or unsafe conduct.
22. INTELLECTUAL PROPERTY, REPORTING, AND SAFETY
22.1 Respect third-party rights. You must not infringe or misappropriate copyright, trademark, patent, trade-secret, publicity, privacy, or other third-party rights.
22.2 Copyright and DMCA. Section 21 of the Terms of Service and any applicable DMCA Policy govern copyright notices, counter-notices, repeat infringement, and related procedures. You must cooperate with lawful removal or restoration requirements and may not submit a knowingly false infringement notice or counter-notice.
22.3 Trademarks and impersonation. You may not use a Channel, username, Creator Content, AI identity, listing, or communication to impersonate or misleadingly suggest affiliation with another person, brand, institution, professional, or authority.
22.4 Child sexual exploitation. Child sexual abuse material and sexual exploitation of minors are prohibited. If Textority obtains the knowledge that triggers a reporting or preservation duty under applicable law, Textority will make the required report and preserve covered material as required by law. You must not possess, download, redistribute, or investigate illegal material in an attempt to report it.
22.5 Non-consensual intimate imagery. Non-consensual intimate imagery, including covered digital forgeries, is prohibited. You must comply with removal or preservation actions Textority takes under the TAKE IT DOWN Act or other applicable law and must not re-upload or facilitate known prohibited copies.
22.6 Reports and cooperation. You must use the reporting routes Textority makes available for conduct or content requiring Textority intervention and must reasonably cooperate with safety, infringement, fraud, and legal investigations relating to your Channel.
23. RECORDS, COOPERATION, AND COMPLIANCE REVIEWS
23.1 Creator records. You must maintain records reasonably necessary to support your legal duties and material transaction representations, including records of required consents, licenses, professional authorizations, material disclosures, delivery or performance, refund and cancellation terms, and communications relevant to disputes, for the period applicable law requires.
23.2 Cooperation. You must respond reasonably and promptly to Textority requests relating to buyer complaints, payment disputes, fraud, safety, intellectual property, privacy, professional licensing, tax, sanctions, provider requirements, or legal obligations.
23.3 Compliance reviews. Textority may review a Channel, listing, Creator Policy, category, AI configuration, messaging practice, verification record, or transaction information where reasonably related to compliance, safety, fraud, payments, taxes, privacy, professional licensing, provider requirements, or a legal obligation.
23.4 Proportionality. Information requests and compliance reviews should be proportionate to the matter under review and limited to information reasonably necessary for the stated purpose. Textority may restrict features while material verification or compliance issues remain unresolved.
23.5 Accurate evidence. You must not fabricate, alter, conceal, or materially misrepresent records or evidence provided to Textority, a payment provider, an End User, a regulator, or another authorized party.
24. OFF-PLATFORM BUSINESS AND ANTI-CIRCUMVENTION
24.1 Lawful outside business. These Creator Terms do not require exclusivity, do not give Textority ownership of your audience, and do not prohibit you from conducting lawful business outside Textority.
24.2 No fee or restriction evasion. You may not deliberately move a specific transaction outside the Services primarily to evade a Textority fee or payment restriction where that transaction was originated, solicited, or materially arranged through Textority and the applicable fee or restriction was clearly disclosed as applying to that transaction or feature.
24.3 No interference with ordinary relationships. Section 24.2 does not prohibit a User from independently finding you elsewhere, does not prevent you from operating another business channel, and does not create a non-compete or general non-solicitation obligation.
24.4 Provider restrictions. You may not route a payment or funds movement through another method in order to evade sanctions, anti-money-laundering, fraud, provider, network, prohibited-category, or legal restrictions.
25. ENFORCEMENT, SUSPENSION, AND TERMINATION
25.1 Terms of Service controls. Section 25 of the Terms of Service governs suspension and termination. Textority may also restrict Creator-specific features where reasonably necessary to address a Creator verification, payment, payout, category, safety, professional, fraud, or provider issue.
25.2 Feature-level restrictions. Textority may restrict selling, payouts, AI, messaging, communities, data exports, or administrative capabilities without terminating the entire account where a narrower restriction is appropriate.
25.3 Existing buyer matters. Suspension or termination does not automatically eliminate obligations relating to existing buyers, purchased access, pending services, refunds, cancellations, payment disputes, chargebacks, taxes, or records.
25.4 Final balances and payouts. Final Creator balances and payouts remain subject to the applicable Creator Payout Terms, reserves, holds, refunds, reversals, disputes, chargebacks, taxes, provider actions, legal restrictions, and unclaimed-property law.
25.5 Serious safety or legal violations. Textority may take immediate action where reasonably necessary to address child sexual exploitation, non-consensual intimate imagery, credible threats, fraud, sanctions, unlawful conduct, serious infringement, account compromise, or another material safety or legal risk.
26. CREATOR REPRESENTATIONS AND WARRANTIES
The Creator represents and warrants that:
(a) the Creator has authority to enter into these Creator Terms and operate the Channel;
(b) information the Creator provides to Textority, payment providers, buyers, and regulators in connection with the Services is accurate in all material respects and will be kept reasonably current;
(c) the Creator owns or has the rights, licenses, releases, permissions, and consents necessary for Creator Content and Creator Offerings and for the licenses granted to Textority;
(d) Creator Content, Creator Offerings, listings, Creator Policies, marketing, communications, and Creator conduct will comply with applicable law and will not infringe or misappropriate third-party rights;
(e) objective claims will be adequately substantiated where law requires substantiation, and material endorsements or relationships will be disclosed where required;
(f) the Creator will maintain required professional, business, category, tax, and other licenses, registrations, approvals, and authorizations;
(g) the Creator will obtain required privacy, messaging, marketing, and audience consents and will honor applicable opt-outs and data rights;
(h) the Creator will not offer a prohibited or unapproved category or use the Services to evade a legal, payment, provider, network, or safety restriction; and
(i) the Creator will comply with the Terms of Service, these Creator Terms, applicable Additional Terms, and applicable law.
A Creator Team Member does not personally make the Creator entity’s representations and warranties solely by accepting a team role, except to the extent a representation concerns that individual’s own conduct, authority, or information personally supplied by that individual.
27. INDEMNIFICATION
27.1 Terms of Service governs. Section 28 of the Terms of Service governs indemnification and is incorporated here by reference.
27.2 Creator matters. As applied to a Creator, the indemnification obligation may include third-party claims arising from Creator Content; Creator Offerings; Creator Policies; professional services; infringement or misappropriation; false or misleading marketing; privacy or messaging violations; taxes for which the Creator is responsible; Creator-configured AI or automation; unlawful conduct; or a material breach of these Creator Terms, subject to the limitations and Textority-conduct carve-out in Section 28 of the Terms of Service.
27.3 Ordinary payment obligations. A refund, reversal, chargeback, dispute fee, negative balance, tax withholding, or other direct payment adjustment is governed by the applicable payment terms and is not converted into a third-party indemnification claim merely by this Section.
27.4 Team Members. A Creator Team Member does not assume the Creator entity’s commercial indemnification obligation solely through assigned access. Section 28.2 of the Terms of Service governs individual Team Member responsibility.
28. DISCLAIMERS, LIMITATION OF LIABILITY, AND RESULTS
28.1 Governing provisions. Sections 26 and 27 of the Terms of Service govern disclaimers and limitation of liability and are incorporated here by reference.
28.2 No business-results guarantee. Textority does not guarantee Creator revenue, audience growth, conversion, reach, retention, ranking, engagement, customer acquisition, search placement, payout timing, or business results.
28.3 Payment obligations. Nothing in these Creator Terms converts an amount Textority is independently required to refund, reverse, return, remit, or pay under applicable law or binding terms into excluded consequential damages.
28.4 Mandatory rights. Liability that applicable law does not permit the parties to disclaim or limit remains preserved.
29. DISPUTE RESOLUTION
29.1 Terms of Service governs. Section 29 of the Terms of Service governs disputes between you and Textority, including informal resolution, arbitration, the class action and jury trial waivers, the arbitration opt-out procedure, small claims, emergency judicial relief, public injunctive relief, the commercial claim period where applicable, governing law, and court venue.
29.2 No separate system. These Creator Terms do not create a separate or conflicting arbitration agreement or dispute process. If these Creator Terms conflict with Section 29 of the Terms of Service on dispute resolution, Section 29 of the Terms of Service controls.
29.3 Mandatory rights. Nothing in these Creator Terms waives a remedy, forum, or procedural right that applicable law does not permit you to waive.
30. CHANGES AND VERSIONING
30.1 Prospective changes. Textority may update these Creator Terms prospectively under Section 30 of the Terms of Service.
30.2 Material changes. For a material change, Textority will provide reasonable notice before the change applies to an existing Creator where applicable law or the nature of the change requires advance notice. Textority will request affirmative reacceptance where required by law or where Textority determines renewed agreement is appropriate.
30.3 Completed transactions. A change to these Creator Terms does not retroactively reduce rights or alter obligations attached to a completed purchase or paid access period where the governing Transaction Terms or applicable law prohibit that change.
30.4 Version records. Textority may maintain prior versions and records of the version accepted by an account.
31. GENERAL
31.1 Entire agreement for Creator matters. These Creator Terms, the Terms of Service, applicable Additional Terms, Transaction Terms, and any written agreement signed by Textority form the agreement governing the Creator’s use of Creator features and the subject matter they address.
31.2 Independent parties. The Creator and Textority are independent contractors. Except where a transaction-specific agreement expressly states otherwise, these Creator Terms do not create a partnership, joint venture, franchise, employment, fiduciary, or agency relationship.

Otherwise, the English version controls to the extent permitted by law.
31.7 Headings. Headings are for convenience and do not limit the meaning of a provision. “Including” means “including without limitation.”
32. GEOGRAPHIC SCOPE AND LOCAL LAW
32.1 Initial launch focus. Textority’s initial launch focus includes the United States and Colombia. Creator selling, payment methods, currencies, categories, and payouts are available only where Textority has actually enabled them.
32.2 Local law. You must comply with the law applicable to your Creator business, Channel, Creator Offerings, marketing, audience, professional activities, transactions, and data processing. Mandatory local law remains effective even if these Creator Terms do not restate it.
32.3 Colombia. If you offer Creator Offerings to consumers in Colombia, Colombian consumer-protection, e-commerce, personal-data, tax, professional, and payment requirements may apply depending on your role and transaction. Textority may provide Regional Terms or transaction-specific disclosures where necessary, but you remain responsible for obligations legally assigned to you.
32.4 Other jurisdictions. A User’s technical ability to view a Channel from another country does not mean Creator selling or payouts are enabled there and does not constitute a representation by Textority that a Creator Offering is lawful or properly licensed in that jurisdiction.
