TEXTORITY AGE ELIGIBILITY POLICY
Last Updated: September 30, 2026
This Age Eligibility Policy applies to textority.com, text.me, text.to, lets.talk, the Textority web platform, and related websites and online services made available by Textority Inc. (collectively, the “Services”).
This Policy supplements the Textority Terms of Service and explains Textority’s current age, guardian-authorization, adult-role, age-assurance, and minor-safety rules. Capitalized terms not defined here have the meanings given in the Terms of Service.
1. PURPOSE, SCOPE, AND RELATIONSHIP TO OTHER TERMS
1.1 Purpose. Textority serves adult Creators, professionals, businesses, and End Users, and may permit certain End Users who are at least 13 and under 18 to use eligible portions of the Services with parent or legal guardian authorization and supervision. This Policy explains who may use which roles and features and how Textority may respond when age or guardian status is uncertain.
1.2 Additional Term. This Policy is an Additional Term under the Terms of Service and governs its specific age-eligibility subject matter. The Terms of Service continue to apply in full.
1.3 Related policies. The Creator Terms, Privacy Policy, Colombia Privacy Notice and Authorization, Acceptable Use Policy, Community and Content Rules, Prohibited Products and Services Policy, Payment Terms, Subscription and Auto-Renewal Terms, and other applicable Textority terms may impose additional restrictions relating to minors, content, communications, purchases, privacy, safety, or specific features.
1.4 No universal legal classification. This Policy does not state that Textority is a child-directed service, a social media platform, or another specially regulated category in every jurisdiction. A jurisdiction-specific rule applies only when its legal definitions, thresholds, and other requirements are actually met.
1.5 Higher local requirements. The minimum age or guardian requirements for a particular User, feature, or jurisdiction may be higher or more restrictive than the baseline rules in this Policy when applicable law requires it. Textority may restrict access accordingly.
2. BASELINE AGE RULES
2.1 Minimum age for End Users. An End User must be at least 13 years old to create or hold a Textority account or use interactive Services intended for account holders, unless Textority expressly establishes a different legally compliant process for a particular Service or jurisdiction.
2.2 Children under 13. A child under 13 may not create an account or use interactive Services intended for account holders. A parent or guardian may not override this rule merely by giving permission unless Textority expressly launches and identifies a legally compliant service for users under 13.
2.3 Teen User. A Teen User is an End User who is at least 13 years old and under 18 years old. Teen Users may use only features, Channels, Creator Offerings, communications, purchases, and other Services that Textority permits for Teen Users and only under the guardian framework in this Policy and the Terms of Service.
2.4 Adults. A User who is at least 18 years old may still be subject to a higher age-of-majority or capacity rule under applicable law for a particular role, contract, transaction, or jurisdiction.
2.5 Publicly viewable material. This Policy does not represent that every publicly accessible Textority webpage is technologically inaccessible to children under 13. The account and interactive-use restrictions in this Policy remain in effect regardless of whether a public webpage can be viewed without an account.
3. ADULT-ONLY ROLES AND FUNCTIONS
3.1 Adult-only roles. You must be at least 18 years old, or the age of majority where you reside if higher, to own or control a Channel, sell a Creator Offering, receive payouts, or hold an administrative, payment, payout, export, moderation, or AI-configuration role for a Channel.
3.2 Entity accounts. An entity may use Textority only through individuals who satisfy the age, capacity, authority, and role requirements applicable to their assigned functions. An entity may not use an underage individual to perform an adult-only role.
3.3 No circumvention. A minor may not use an adult’s identity, payment account, Creator account, team seat, or credentials to obtain an adult-only role. An adult may not nominally hold a role for the purpose of allowing a minor to exercise adult-only control in substance.
3.4 Verification. Textority may require reasonable evidence of age, identity, legal capacity, business authority, or role eligibility before or after enabling an adult-only function.
4. GUARDIAN AUTHORIZATION FOR TEEN USERS
4.1 Required authorization. A Teen User may use the Services only with the authorization and supervision of a parent or legal guardian, subject to applicable law and any more specific Textority requirements for the relevant feature or transaction.
4.2 Guardian review. The parent or legal guardian should review the Terms of Service, this Policy, the Privacy Policy, applicable safety rules, and any transaction or feature terms presented for the Teen User before authorizing use.
4.3 Guardian acceptance. Where Textority presents a guardian acceptance or authorization flow, the guardian must provide truthful information and complete the action required by the flow. Passive awareness, silence, or a Teen User’s representation that a guardian approved may be insufficient where Textority requires direct guardian action.
4.4 Supervision. The guardian is expected to provide the supervision required by the Terms and this Policy. This does not create an absolute guarantee that the guardian can prevent every act by the Teen User or every interaction with third parties.
4.5 Guardian authority. A person may provide guardian authorization only if legally authorized to act for the Teen User. Textority may request evidence of guardianship or authority where reasonably necessary.
4.6 Withdrawal. A guardian may withdraw authorization through a method Textority makes available. Withdrawal may require Textority to restrict or close the Teen User account or disable affected features, subject to retention, transaction, safety, legal, and other obligations that survive account closure.
5. PURCHASES, SUBSCRIPTIONS, AND PAID ACCESS FOR TEEN USERS
5.1 Guardian authorization for purchases. A purchase, paid enrollment, or recurring subscription connected to a Teen User requires the parent or legal guardian authorization required by the Terms of Service, applicable Transaction Terms, and applicable law.
5.2 Payer. The checkout and Transaction Terms identify the payer and the person financially responsible for the charge. A Teen User may not independently assume an adult-only seller, payout, payment-administration, or merchant role.
5.3 Recurring charges. Guardian authorization for a recurring enrollment applies only to the charges, frequency, price, renewal mechanics, cancellation terms, and other material terms properly disclosed for the authorized enrollment. Material changes remain subject to the Subscription and Auto-Renewal Terms and applicable law.
5.4 Restricted purchases. Textority may prohibit or limit Teen Users from purchasing or accessing particular Creator Offerings, categories, subscriptions, services, or features based on safety, content, legal, payment-provider, professional, or product requirements.
5.5 No circumvention. A Teen User may not use false age information, another person’s payment method without authorization, or another account to bypass a purchase or age restriction.
6. TEEN-ELIGIBLE CHANNELS, CONTENT, AND FEATURES
6.1 Textority controls eligibility. A Channel, Creator Offering, communication mode, AI feature, community, or other feature is available to Teen Users only if Textority permits Teen User access. A Creator cannot make a feature teen-eligible merely by labeling it as appropriate for minors.
6.2 Category restrictions. Textority may designate particular content, Creator Offerings, communications, professional categories, or features as adult-only or otherwise unavailable to Teen Users even if the material is lawful for adults.
6.3 Safety restrictions. Textority may apply additional restrictions to Teen Users concerning direct communications, public visibility, discovery, recommendations, purchases, AI features, file sharing, community participation, contact information, or other functionality where reasonably related to safety, privacy, legal compliance, or product design.
6.4 Creator responsibilities. A Creator whose Channel or Creator Offering is available to Teen Users must comply with the Terms of Service, Creator Terms, Community and Content Rules, Acceptable Use Policy, applicable privacy and communications requirements, and any age-specific restrictions Textority presents.
6.5 No targeting children under 13. A Creator must not knowingly direct an interactive Channel or Creator Offering to children under 13, encourage a child under 13 to create an account, instruct a person to falsify age, or knowingly continue an account-based interactive relationship after learning that the User is under 13.
7. PROHIBITED CONDUCT INVOLVING MINORS
7.1 Exploitation prohibited. Child sexual abuse material, grooming, sexual exploitation, sexual solicitation of minors, sextortion, trafficking, predatory conduct, and other exploitation of minors are prohibited under the Terms of Service, Acceptable Use Policy, Community and Content Rules, and applicable law.
7.2 Guardian-evasion conduct. A User may not pressure a minor to conceal activity from a parent or legal guardian, solicit secret communications for the purpose of evading lawful guardian safeguards, falsify guardian approval, or interfere with an age or safety review.
7.3 Manipulative practices. A User may not use coercive, deceptive, or materially exploitative tactics to pressure a Teen User into a purchase, disclosure of sensitive information, sexual interaction, off-platform contact, or another action that creates a material safety or legal risk.
7.4 Unnecessary sensitive information. A Creator or other User must not request unnecessary sensitive personal information from a Teen User, particularly where the information is unrelated to the permitted purpose of the interaction.
7.5 Reporting. Users should report suspected exploitation, grooming, age circumvention, or other serious safety concerns through the reporting route Textority makes available. Do not possess, download, redistribute, or investigate illegal material merely to make a report.
8. AGE INFORMATION AND AGE ASSURANCE
8.1 Age information. Textority may request age information, date of birth, an age band, confirmation that a User is above or below a threshold, or other information reasonably necessary to determine eligibility.
8.2 Additional assurance. Where reasonably necessary for a feature, jurisdiction, safety review, or legal requirement, Textority may use additional age-assurance or verification methods, including methods provided by qualified service providers. The method may vary based on the level of assurance reasonably needed and available technology.
8.3 Data minimization. Textority should seek to collect and retain no more information than reasonably necessary for the relevant age-assurance purpose, legal obligation, fraud prevention, audit requirement, or dispute. Age-assurance information is subject to the Privacy Policy and Data Retention and Deletion Policy.
8.4 No guarantee. An age-assurance result is evidence for the purpose for which the check was performed. It is not a guarantee of a person’s identity, maturity, suitability, honesty, safety, or conduct.
8.5 Service providers. Textority may use service providers to assist with age or identity assurance where appropriate. Use of a provider does not authorize unrelated use of the information by Textority and remains subject to applicable privacy obligations and provider arrangements.
8.6 Neutrality and accuracy. When Textority uses an age-screening or age-assurance method, it may design the process to discourage false age entry and to provide reasonably accurate results without collecting unnecessary information, consistent with applicable law and product capabilities.
9. FALSE AGE INFORMATION AND AGE-CONTROL EVASION
9.1 Accurate information required. A User must provide truthful age, date-of-birth, guardian, and eligibility information when Textority requests it.
9.2 Evasion prohibited. A User may not alter, fabricate, borrow, or misuse identity information; create replacement accounts; use another person’s credentials; manipulate a device or account; or use another method primarily to bypass an age restriction, age-assurance process, guardian requirement, or age-based enforcement action.
9.3 Guardian misconduct. A guardian or adult may not knowingly provide false authorization, falsely claim guardianship, or knowingly assist a minor in evading an age restriction.
9.4 Consequences. Textority may restrict features, suspend access, require additional verification, terminate an account, or take another proportionate action where Textority reasonably believes age or guardian information is false, incomplete, inconsistent, or being used to evade applicable rules, subject to applicable law.
10. WHEN TEXTORITY LEARNS A USER MAY BE UNDER 13
10.1 Immediate restriction. If Textority obtains actual knowledge or other legally sufficient information that an account is held by a child under 13 in violation of this Policy, Textority may restrict the account and interactive functionality while the matter is reviewed.
10.2 Account action. If Textority determines that the User is under 13 and no legally approved Textority process permits that use, Textority may terminate or disable the account and associated interactive access.
10.3 Personal information. Textority will handle personal information associated with a known child under 13 as required by applicable law, including applicable deletion, parental-notice, access, security, and retention obligations. Textority will not retain such information merely to preserve an ineligible account.
10.4 Limited preservation. Textority may retain information where legally required or reasonably necessary for child safety, fraud prevention, security, a legal hold, a valid government request, evidence of compliance, or another lawful purpose, subject to the Data Retention and Deletion Policy and applicable law.
10.5 No self-investigation of illegal content. A User, Creator, or guardian must not request, download, preserve, redistribute, or investigate illegal sexual material involving a minor in an attempt to determine age or substantiate a report.
11. UNITED STATES CHILDREN’S PRIVACY
11.1 COPPA baseline. Textority’s current account eligibility rule does not permit children under 13 to create accounts or use interactive Services intended for account holders. The Services are not offered under this Policy as a child-directed account service for children under 13.
11.2 Covered circumstances. If the Children’s Online Privacy Protection Act and its implementing rule apply to a particular Textority service or data flow, Textority will provide the notices, parental controls, verifiable parental consent, access, deletion, security, retention, and other protections required by then-current law.
11.3 Actual knowledge. Textority may obtain legally relevant knowledge of a User’s age through information submitted by the User, a guardian, an age-assurance process, a report, or another source recognized by applicable law. This Policy does not require Textority to infer a specific age from unrelated characteristics where the law does not impose that duty.
11.4 Parental consent does not override eligibility. A COPPA parental-consent mechanism, where legally applicable, concerns processing of a child’s information. It does not by itself create a right for a child under 13 to use an account or feature that Textority has not made eligible for that age group.
12. COLOMBIA AND PERSONAL DATA OF MINORS
12.1 Enhanced protection. Personal data relating to children and adolescents in Colombia is subject to enhanced protection under applicable Colombian law. Textority will process such data only where the processing is legally permitted and consistent with the best interests and fundamental rights of the minor.
12.2 Guardian authorization and the minor’s participation. Where Colombian law requires authorization by the minor’s legal representative, Textority will apply the applicable authorization framework and respect the minor’s right to be heard, taking account of maturity, autonomy, and capacity to understand the matter as required by law.
12.3 Relationship to Textority rules. Compliance with Colombian data-protection requirements does not independently make an under-13 User eligible for a Textority account. The account eligibility rules in Sections 2 and 10 continue to apply unless Textority expressly establishes a legally compliant alternative service.
12.4 Colombia privacy documents. The Textority Privacy Policy and Colombia Privacy Notice and Authorization provide additional information about personal-data processing and applicable rights.
13. JURISDICTION-SPECIFIC AGE AND PARENTAL-CONSENT LAWS
13.1 Evolving requirements. Some jurisdictions impose age-assurance, parental-consent, parental-access, deletion, default-setting, or other requirements on online services that meet specific statutory definitions. These requirements may change and may be subject to litigation, regulatory interpretation, thresholds, exemptions, or feature-specific rules.
13.2 Applicability assessment. Textority will apply a jurisdiction-specific requirement when the requirement legally applies to Textority and the relevant Service, User, or feature. Publication of this Policy does not concede that Textority falls within every statutory definition used by every jurisdiction.
13.3 Higher minimum age. If applicable law prohibits a person of a particular age from holding an account or requires a higher minimum age that Textority cannot operationally support, Textority may block account creation, restrict access, or close the affected account as required by law.
13.4 Additional guardian process. If applicable law requires a form of guardian consent, notice, authentication, access, or supervision beyond Textority’s baseline guardian framework, Textority may require the additional process before allowing continued access.
14. AGE-RESTRICTED CONTENT, PRODUCTS, AND SERVICES
14.1 Separate from account eligibility. Being eligible to hold a Textority account does not make a Teen User eligible for every Channel, Creator Offering, communication, community, or feature.
14.2 Adult-only access. Textority may restrict to adults any content, product, service, professional category, communication mode, or feature where adult-only access is required or reasonably appropriate because of law, safety, provider requirements, product design, or the nature of the offering.
14.3 Creator labeling is not controlling. A Creator’s statement that material is suitable for minors does not override Textority’s age restrictions, Community and Content Rules, Prohibited Products and Services Policy, or applicable law.
14.4 App or store ratings. An app-store, device, content, or third-party age rating does not by itself change Textority’s account, guardian, Creator, purchase, or feature eligibility rules.
15. PRIVACY, RECORDS, AND GUARDIAN REQUESTS
15.1 Privacy notices. The Privacy Policy and applicable regional notices describe how Textority processes age, guardian, verification, account, and related personal information.
15.2 Records. Textority may maintain records reasonably necessary to evidence age or guardian authorization, acceptance of terms, eligibility decisions, safety actions, purchases, disputes, and legal compliance, subject to the Data Retention and Deletion Policy and applicable law.
15.3 Guardian requests. A verified parent or legal guardian may submit an age, safety, privacy, or account-related request concerning a minor where the guardian has legal authority to do so and applicable law permits or requires the request. Textority may require reasonable verification before disclosing or changing account information.
15.4 Privacy rights. Requests to access, correct, delete, or otherwise exercise privacy rights should follow the Privacy Center / Your Privacy Choices and applicable regional procedures.
15.5 Safety limitations. Textority may limit disclosure to a guardian where disclosure would violate applicable law, expose another person’s information, compromise a safety investigation, or create a material risk to a minor or another person. Mandatory guardian rights remain preserved where applicable.
16. ACCOUNT RESTRICTION, REVIEW, AND APPEAL
16.1 Age-related restriction. Textority may temporarily restrict an account or feature while reviewing credible information that the User does not satisfy an applicable age, guardian, role, or jurisdictional requirement.
16.2 Reasonable evidence. Textority may request information reasonably necessary to resolve the eligibility question. Textority should avoid requesting information unrelated or disproportionate to the issue being reviewed.
16.3 Review route. Where Textority makes an age-eligibility review or appeal route available, the affected User or authorized guardian may provide information supporting eligibility. An appeal does not automatically restore access while the review is pending.
16.4 False documents. Submitting falsified identity, age, guardian, or authorization evidence may result in enforcement under the Terms of Service and Acceptable Use Policy.
16.5 Mandatory rights. Textority’s internal review process does not limit a non-waivable right under applicable law.
17. CREATOR AND BUSINESS OBLIGATIONS
17.1 No under-13 targeting. Creators must comply with Section 4.5 of the Terms of Service and Section 20 of the Creator Terms concerning children under 13 and Teen Users.
17.2 Age-aware design. A Creator that knows its Channel or Creator Offering is available to Teen Users must not intentionally design the experience to defeat Textority age controls, guardian requirements, safety restrictions, or legally required protections.
17.3 Independent obligations. A Creator may have independent age, privacy, professional, advertising, consumer, or safety obligations based on the Creator’s audience, jurisdiction, services, communications, and use of personal information. Textority does not assume those independent obligations merely because the Creator uses the Services.
17.4 Cooperation. A Creator must reasonably cooperate with Textority when Textority restricts a Channel, communication, Creator Offering, transaction, or feature to address a credible age, guardian, child-safety, or legal concern.
18. CHANGES AND ORDER OF PRECEDENCE
18.1 Prospective changes. Textority may update this Policy prospectively in accordance with Section 30 of the Terms of Service, including to respond to changes in law, age-assurance technology, safety requirements, provider rules, or product design.
18.2 Material changes. Textority will provide reasonable notice of a material change where applicable law or the nature of the change requires advance notice and will request affirmative reacceptance or renewed guardian authorization where required.
18.3 Order of precedence. Section 30.5 of the Terms of Service governs conflicts among applicable documents. Mandatory law controls where it cannot be varied by agreement.
18.4 No retroactive eligibility guarantee. A User who was previously eligible for a feature does not acquire a permanent right to continued eligibility if applicable law, safety requirements, or product rules later require a prospective restriction, subject to applicable notice and non-waivable rights.
